In the United States, in its political program, the Republican Party has indicated that it considered inadequate the decision of the Department of Justice adopted in December 2011, according to that the prohibition of poker does not apply when this game was played on line. Indeed, the Republican Party said that this game can be pathological, because it can destroy the players and their families. As such, the distorted interpretation that the previous administration that made of the Wire Act should be canceled for that to be restored, according to it, the outright prohibition of online poker. This program must be compared, in contrast with the court decision, which comes instead to ask that poker can be freely organized, because it is not even a gambling game.

In the United States, if the State courts took different positions on whether the game of poker is a game of chance or a game of strategy, this is the first time that a federal jurisdiction decides the issue by this judgment of August 21, 2012 ruled by Judge Jack Weinstein. The question is crucial for the Regulation of online gambling because gambling is regulated or even prohibited by State, but not strategy games. Qualification depends on the definition that is given in the game according to the judge, who relied on recent scientific studies, the gain in poker does not depend poker mostly luck but skill. Therefore, it escapes the regulations that surround gambling.

Two North American representatives to the Congress introduce a Bill organising exchanges of information between private undertakings, mainly the Internet Service Providers, social networks, search engines and the National Security Agency (NSA). The purpose is to protect sites against cybercrime, espionage, etc. Undertakings expressed their disagreement regarding the previous project aims at organising the access to their data stored in favour the FBI (the Federal Bureau of Investigation) to serve the security of the country, are this time in favour of the Bill, because it protects their systems, but the associations of the defence of fundamental freedoms are opposed, by referring to the fourth amendment, which protects every citizen of any non-motivated order for seizure. A Chinese company issued shares on American exchanges, and was subsequently the subject of a Securities and Exchange Commission (SEC) investigation. The company’s auditor concomitantly revealed frauds it had discovered during its review of the company’s accounts. The SEC sued the auditor on May 27, 2011 in order to force it to communicate the documents it held. The auditor refused, arguing that Chinese criminal law prohibited the revelation of such documents. The SEC filed a motion in Federal Court to compel the auditor to comply with its request on September 6, 2011.

This report ambits to improve the regulation of industrial networks in France and in Europe. Therefore, the Fondation nationale Entreprise et Performance (FNEP) concentrates its study on industrial networks, a category in which it includes telecommunications, energy, rail transportation, and postal services, in France and in Europe. The report proposes new rules or adaptations to old ones in order to increase regulators’ independence, efficacy, and oversight. It then suggests rules be modified to allow for the implementation of regulation at the European level, whenever the relevant market is European in scale.

Ce rapport ambitieux vise à améliorer la régulation des réseaux industriels en France et en Europe. Par conséquent, la Fondation nationale Entreprise et Performance (FNEP) concentre son étude sur les réseaux industriels, une catégorie dans laquelle le rapport inclut les télécommunications, l’énergie, le transport ferroviaire, et les services postaux, en France et en Europe. Le rapport propose de nouvelles règles ou des adaptations de précédentes, afin d’accroître l’indépendance des régulateurs , d’augmenter l’efficacité et la surveillance. Il propose ensuite que des règles soient modifiées pour permettre la mise en œuvre de la régulation au niveau européen, chaque fois que le marché pertinent est de dimension européenne.
