Thematic Report (Energy): The French energy regulator publishes its first unfavorable opinion regarding the government’s proposed natural gas tariffs for residential customers.

The Commission de Régulation de l’Energie (CRE — French energy regulator) published an opinion “regarding the draft executive order regarding the regulated tariffs for natural gas publicly distributed by GDF Suez.” This non-binding opinion was published on September 29, 2011, and claims that it is not acceptable for the Government to leave natural gas prices unchanged because these prices do not cover GDF Suez’s costs and symmetrically prevent newcomers from competing with it.

Relazione tematica (Energia): L’autorità di regolazione francese nel settore dell’energia ha reso pubblica il suo primo parere sfavorevole a proposito delle tariffe del gaz proposte dal governo per le utenze residenziali


La Commission de Régulation de l’Energie (CRE – l’autorità francese di regolazione nel settore dell’energia) ha reso pubblico un parare « riguardante la bozza di proposte di tariffe per il gaz naturale distribuito da GDF Suez ». Questo parere non vincolante è stato pubblicato il 29 settembre 2011 e afferma che non è possibile per il Governo di lasciare immutati i prezzi del gas naturale poiché questi prezzi non coprono i costi di GDF Suez e, al contempo, impedisce ai nuovi operatori di competere con tali costi.

The Autorité de régulation des communications électroniques et des postes (ARCEP — French telecommunications and postal regulator) issued an injunction on November 4, 2010, ordering Numéricâble to sign a contract with France Telecom according to the latter’s new framework for accessing its telecommunications infrastructure for the installation of fiber optics. Failure to have complied within the imparted timeframe caused Numéricâble to be fined 5 million Euros by the ARCEP on December 20, 2011.

L’Autorité de régulation des communications électroniques et de la poste (ARCEP) avait, par une décision du 4 novembre 2010, fait injonction à Numéricâble de contracter avec France Telecom selon la nouvelle offre de celui-ci pour l’accès à l’infrastructure de génie civil pour la fibre optique. Il 4 novembre 2010, la Autorité de régulation des communications électroniques et des postes (ARCEP — l’Autorità francese di regolazione in materia di telecomunicazione e servizi postali) ha emesso un’ingiunzione, ordinando a Numéricâble di sottoscrivere un contratto con France Telecom secondo l’offerta di quest’ultima per l’accesso alle infrastrutture per l’installazione della fibra ottica. Il 20 dicembre 2011, a ragione del mancato rispetto di tale ordine, Numéricâble è stata multata per 5 milioni di euro dall’ARCEP.

Breaking news

On June 19, 2012, the European Parliament adopted an extensively modified version of the draft text prepared by the European Commission on credit rating agencies. It does not address the issue of the concentration of the rating market, believing that this is a matter of competition and not of regulation. It reduces the scope of the rotation rule in three years and only for structured products. It requires agencies to issue a schedule of two or three dates in the year where they can change their sovereign debt notes. Next to these devices of ex ante regulation, Parliament adopts an ex post system, civil liability of agencies, in which it will be for them to demonstrate to investors that they have complied with the rules in force.

In the field of the competition law, due to the lack of ex-ante regulation device, the European Commission sued Microsoft for abuse of dominant position, in that the company refused to disclose to its competitors certain information on interoperability and to allow the use for the development of competing products. The decision of sanction of the Commission of 24 March 2004 had established the abuse of dominant position by such behaviour and had chosen as a sanction the appointment of an independent trustee that can access the source code and ensure access to competitors. The Commission, by decision of 12 July 2006, accompanied the operative part of the decision by a penalty payment. The Court of first instance of the European Union, seized by Microsoft for annulment, confirms the operative part of the decision, especially in view of the innovation criterion, but decreases the amount of the penalty payment.

"Acting in a neutral way" is an oxymoron. "Companies often require however that States use their powers in a neutral way (eg tax neutrality). In regulated sectors, some are right or even duty , of not being neutral. Firstly, it is the State, which requires the market for other purposes, other temporalities and other values​​. Secondly, they are also the "crucial operators", which are sort of regulators of second degree, such as transmission system operators or companies capital markets firms. The difficulty increases when the systeme requires neutrality of regulators and judges, when first build economic policy and the second create jurisprudence. Their consistency, impartiality and rationality can create an objectifiable neutralitys

«Agir de façon neutre» est un oxymoron. «Les entreprises ont souvent besoin, cependant, que les États utilisent leurs pouvoirs de manière neutre (neutralité fiscale par exemple).

Dans les secteurs réglementés, certains ont le droit ou même le devoir de ne pas être neutre. Tout d’abord, c’est l’État, qui insère le marché à d’autres fins, d’autres temporalités et d’autres valeurs. In itself, regulation does not necessary require judicial review of regulators’ acts, whether the regulator is a ministry or an independent authority. In short, regulators could have the “last word” in all circumstances. However, because of an equal concern for democratic legitimacy and care to respect its international commitments, the French Parliament is convinced that judicial review over regulators’ actions is necessary.
