JoRC

Like the previous cycles devoted to the general theme of Compliance and aiming to build a "Compliance Law", intended like them to be published in the Regulations & Compliance collection, this cycle addresses a particular aspect of this branch of Law in progress. to develop. "Compliance tools" having been the subject of the previous cycle of conferences and showing judges, lawyers, jurisdictions, this new cycle addresses a new phenomenon in Compliance: La juridictionnalisation de la Compliance (The jurisdictionalisation of Compliance).

It will take place in parallel with the series of conferences on the theme: Les buts monumental de la Compliance (The monumental goals of Compliance).

There have always been judges and lawyers in Compliance Law, in particular because this is the extension of Regulatory Law in which they have a full place. This results from the fact that the decisions taken in respect of Compliance are contestable in court, those issued by the company, such as those of States or Authorities. The novelty lies more in the phenomenon of "legalization", that is to say that the jurisdictional model penetrates all Compliance Law, and not only the Ex Post part that this includes. Furthermore, it seems that this jurisdictionalization influences the non-legal dimension of Compliance. This movement has effects that must be measured and causes that must be understood. Advantages and disadvantages that must be balanced. If only to form an opinion on this "juridictionalization of Compliance".

The book "Concurrence, santé publique, innovation et médicament" (Competition, public health, innovation, and medicine), published by French publisher L.G.D.J., provides an analysis of the pharmaceutical sector’s oscillation between competition and regulation. The first part of the study is consecrated to "Médicament dans la regulation des dépenses de santé" (The role of medicine in the regulation of healthcare costs), which exposes health-related questions in their most government-controlled aspect. The second part conceives health through its social function, with "Innovation et incitation à la recherche" (Innovation and incentive to perform research), while the last part explains "Les difficultés des prises en compte par le droit de la concurrence des spécificités du secteur pharmaceutique" (Competition Law’s difficult apprehension of the pharmaceutical sector’s specificities). The three parts of this study offer an exhaustive presentation of the stakes involved in healthcare law, economy, and policy, and clearly shows that the hybrid nature of this sector makes it more a matter for regulation rather than for competition law.

In February 2011, the "Autorité de régulation des jeux en ligne" (ARJEL – French Online Gambling Regulatory Authority) has asked Pokerstars to shut down its Home Games, which the online gambling site has agreed to do. After that,the regulator has written to all operators to remind them that any modification of their platforms must be submitted to it for prior approval. This appoval has been given on may, 12, 2011. The Home Game is reserved to players, which account member has been validated by Pokerstar.

Durante il mese di febbraio 2011, la "Autorité de régulation des jeux en ligne" (ARJEL – l’Autorità francese di regolazione delle scommesse online) ha richiesto alla società Pokerstars di interrompere il suo Home Games e la società si è conformata a tale richiesta. Successivamente, l’Autorità di regolazione ha scritto a tutti gli operatori ricordando che ogni modificazione della loro piattaforma dovrà essere sottoposta alla sua autorizzazione. Il 12 maggio 2011, è stata concessa questa autorizzazione. The Home Game è dunque riservato a degli utenti, il cui account è stato controllato e confermato da Pokerstars.
