On December 20, 2011, the Autorité de Régulation des Communications électroniques et de la Poste (ARCEP — French postal and telecommunications regulator) fined La Poste, France’s universal postal service provider, one million Euros for not having provided an easily-available and affordable priority mail service for the shipment of low-value objects weighing less than two kilograms. This failure was in disregard of the regulator’s injunction, French legislation, and European directives.

Par une décision du 20 décembre 2011, l’Autorité de Régulation des Communications Electroniques et de la Poste (ARCEP), condamne à une amende d’un million d’Euros l’opérateur en charge du service universel, La Poste, car celle-ci n’a pas offert d’une façon accessible et abordable, sur un modèle proche de la « lettre », l’envoi d’objet de faible valeur de moins de deux kilos. En cela, l’opérateur a méconnu la mise en demeure du régulateur, la loi française et les directives communautaires.

El 20 de diciembre del 2011, la Autorité de Régulation des Communications électroniques et de la Poste (ARCEP – el Regulador francés de servicios postales y telecomunicaciones) multaron a La Poste, el proveedor universal de servicios postales en Francia, un millón de Euros por no haber proveído un acceso fácil y asequible a un servicio postal prioritario por el envío de objetos de poco valor pesando menos de dos kilogramos. Este fallo fue un acto de indiferencia del mandamiento judicial del regulador, de la legislación francesa y de las directivas europeas.

Il 20 dicembre 2011 l’“Autorité de Régulation des Communications électroniques et de la Poste (ARCEP – l’autorità di regolazione francese in materia di servizi postali e telecomunicazione) ha fatto una multa a “Le Poste”, fornitore francese del servizio universale di posta, per un importo di un milione di euro per non aver fornito un servizio di posta celere accessibile e affidabile per la consegna di oggetti di poco valore e di un peso inferiore ai due chili. La Poste ha quindi commesso tale infrazione violando la diffida dell’autorità di regolazione, la legislazione francese e le direttive europee.

On December 20, 2011, the European Commission adopted a decision based on the Almark ruling that expounds upon the four conditions necessary so that compensation paid by a State to any state-owned or private company entrusted with the operation of a public service not require prior notification of the European Commission, despite the general prohibition on State Aids. Each state has a wide margin of discretion in the definition of services that could be classified as being services of general economic interest. A communication and de minimis regulation will complete this decision.

Par une décision du 20 décembre 2011, la Commission Européenne, s’appuyant sur l’arrêt Almark , développe les 4 conditions pour que les compensations versées par un Etat à une entreprise, qu’elle soit publique ou privée, pour qu’elle assure un service public, ne donne pourtant pas lieu à notification à la Commission européenne, malgré la prohibition des aides d’Etat. Les Etats sont légitimes à définir les activités qui relèvent de l’intérêt économique général. Une communication et un règlement de minimis complèteront cette décision.

El 20 de diciembre del 2010, la Comisión Europea adoptó una decisión basada en la decisión Almark que trata de las cuatro condiciones necesarias para que una compensación pagada por el Estado a cualquier empresa pública o privada no requiera de una notificación previa a la Comisión Europea, a pesar de la prohibición general sobre Asistencias Estatales. Cada estado tiene un gran margen de discreción en la definición de servicios que podrían ser clasificados como servicios de interés económico general. Una comunicación y regulación de minimis completará la decisión.

Il 20 dicembre 2011, la Commissione europea, sulla base della decisione Almark, ha identificato le quattro condizioni in presenza delle quali gli aiuti dati dallo Stato ad un’azienda, pubblica o privata, per far assicurare un servizio pubblico, non sarà necessario fare una notifica alla Commissione, nonostante il divieto di procedere con degli aiuti di Stato. Ogni Stato avrà un ampio margine di manovra nella definizione dei servizi che possono essere qualificati come servizi di interesse generale. Una comunicazione ed un regolamento de minimis completeranno questa decisione.

On November 4, 2010, the French telecommunications regulator obliged a fiber optic network operator to obey certain conditions for the access to civil engineering infrastructures that it had not accepted in its contracts with the civil engineering infrastructure operator. The Court of Appeals of Paris confirmed this ruling on June 23, 2011 on the grounds that the civil engineering operator required all fiber optic network operators to behave identically.

Par une décision du 4 novembre 2010, le régulateur français des télécommunications avait obligé un opérateur de réseau fibre, pourtant titulaire de contrats, à observer des contraintes contenues dans l’offre “accès au génie” qu’il n’avait pas acceptées. La décision est approuvée par la Cour d’appel de Paris le 23 juin 2011, car l’opérateur du génie civil a besoin de comportements homogènes de la part de tous les opérateurs de fibres optiques.

El tema de la neutralidad trae a luz un cierto número de ideas preliminares.
Para comenzar, la figura de Buda viene a mente, porque él sólo expresa la naturaleza interminable que es el tema de la neutralidad, ya que al pensar en el hecho de que él no piensa en absolutamente nada, Buda aún así piensa en algo. También me hace pensar el intento constante de la música contemporánea de alcanzar una forma de neutralidad: pero este objetivo permanece inalcanzable, porque es evidente que la búsqueda de lo neutral, en un sonido o un timbre, probablemente nunca se podrá encontrar.

This report ambits to improve the regulation of industrial networks in France and in Europe. Therefore, the Fondation nationale Entreprise et Performance (FNEP) concentrates its study on industrial networks, a category in which it includes telecommunications, energy, rail transportation, and postal services, in France and in Europe. The report proposes new rules or adaptations to old ones in order to increase regulators’ independence, efficacy, and oversight. It then suggests rules be modified to allow for the implementation of regulation at the European level, whenever the relevant market is European in scale.

Tuttavia la “Fondation Nationale Entreprise et Performance” (FNEP) focalizza la sua attenzione sulle reti industriali, una categoria che include le telecomunicazioni, l’energia, il trasporto ferroviario ed i servizi postali, in Francia ed in Europa. La relazione propone delle nuove regole o una modifica delle regole esistenti per aumentare l’indipendenza, l’efficacia e la vigilanza delle autorità di regolazione. Inoltre, propone di modificare alcune norme per permettere l’applicazione della regolazione al livello europeo, ogni volta che il mercato rilevante è quello europeo.
