The Autorité de la régulation des communications électroniques et des postes - ARCEP (French Telecommunications and Posts Regulator) organized the Colloquium on "la neutralité des réseaux" The Network Neutrality), which took place on April 13, 2010. Each actor uses the generality of the term ‘neutrality’ in an interpretation that best suits his opinions. However, neutrality means that there should be no discrimination between Internet users; however, it does not mean that they have the right to everything for free: because there has to be some sort of traffic and bandwidth management, consumer and copyright protection, it is necessary to strike a balance between these contradictory rights in order to allow the network to develop. Therefore, a regulator is necessary. The future development of the Internet depends upon it. For the moment, nobody knows who these legitimate regulators are, and how they would be able to regulate these competing forces, organize information transparency, and encourage long-term investment, while preserving competition at the same time.

Symposiums

The implementation of a joint service on Insurance, Banking, and Insurance within the ‘Autorité de Contrôle prudential – ACP’ (French Prudential Control Authority), raises questions as to the way in which the service will be coordinated with the ‘Autorité des marchés financiers – AMF’ (French financial markets authority’s) other activities. The signature of the agreement creating the new joint service was the occasion for Jean-Pierre Jouyet, President of the AMF, to clarify that this joint service’s principal goal is consumer protection. The coordination between the AMF and the ACP is intended to improve efficiency and credibility to further this goal.

In order to establish a competitive energy market, the distribution infrastructure, as a monopolistic segment of energy networks, should be demonopolized. Instruments of economic regulation, which are often attributed ex ante character, are put in place to open the market and enable competitive forces. Unbundling is specific for it may also represent an ex post measure of a structural nature, exerted by competition protection authorities.

Afin d’établir un marché énergétique compétitif, l’infrastructure de distribution, en tant qu’il est un segment monopolistique des réseaux d’énergie, devrait être libéralisé. Les instruments de régulation économique, qui sont souvent attribués d’une façon ex ante, sont mises en place pour ouvrir le marché et rendent possibles les forces concurrentielles. Le dégroupage est spécifique, car il peut aussi représenter une mesure ex post de nature structurelle, exercée par les autorités de protection de la concurrence.
