Judges, regulatory and supervisory authorities, or even authorities specially instituted by Compliance Law, such as the Agence Française Anticorruption (French Anticorruption Agency), must implement it.
The colloquium aims initially to identify and discuss the procedural rules that they then specifically implement, in particular when the strong requirements of Compliance Law, efficiency and immediacy, new negotiation techniques and commitment, must be articulated with the traditional procedural requirements that remain.
The question arises in particular as to whether the rules of a fair trial should apply (or can they be similar in transactional procedures and in the context of judicial procedures, and how the control by judges operates during homologation) in transactional procedures, with more or less specific treatment of the evidence used.
Secondly, the colloquium considers the way in which the different judges assess the different constitutive standards of Compliance Law. These are often soft Law and depending on whether the judge is repressive, administrative, or European, his or her assessment will not be legally of the same scope or of the same nature, which together leads to an issue of articulation of method. Due to the breadth of the subject, certain sectors will be particularly examined, in particular the banking sector.
Thirdly, the way in which the judge himself or herself applies Compliance Law will be examined, in what appears to be a balance between pedagogy and sanction. It then appears to play a triple role, in that it ensures compliance with standards but also in that it must find effective solutions in a Law which is more in Ex Ante than in Ex Post and that it must support operators so that they act effectively, by mastering their obligations. The motivation for decisions then appears to be a primary issue.
Because this last phase concerns the even more direct relationship between the judge and the operators and stakeholders, this theme is intended to give rise to a presentation and a round table.
Libor is the rate set by the bank statements, anticipating purchases liquidity between them. The Libor rate is the result of self-regulation. On this rate, the financial system leans to fix rates many different financial transactions. However, now many banks are sued by authorities, for manipulation. The banks made false statement or organize a cartel, producing a rate in their favor. From the condemnation of the Barclays 26 June 2012 by the Financial Services Authority (FSA), the commencement of proceedings, the constitution of the Commission to think reform Libor estimated pernicious, banks choose their strategy. Most prefer to cooperate fully in themselves investigation leading home and helping the authorities. This was the case of the Royal Bank of Scotland (RBS). Today it is the case of Société Générale (SocGen).
Through the publication of a new regulatory framework by Postcomm, the British Postal Services Commission, on May 27, 2010, Postcomm outlines its plans for regulating the postal sector in the years following 2012. This framework plans to adapt postal regulation to allow {Royal Mail} to profitably fulfill its Universal Service Obligations faced with drastically declining mail volumes and increased competition.

The Autorité de régulation des communications électroniques et des postes (ARCEP — French telecommunications and postal regulator) issued an injunction on November 4, 2010, ordering Numéricâble to sign a contract with France Telecom according to the latter’s new framework for accessing its telecommunications infrastructure for the installation of fiber optics. Failure to have complied within the imparted timeframe caused Numéricâble to be fined 5 million Euros by the ARCEP on December 20, 2011.

La banque UBS a informé le 26 novembre 2012 qu'elle avait sanctionné par la Financial Services Authority (FSA) pour un comportement illicite de son ex-trader. Son communiqué insiste sur le fait que l'amende est moindre de 30% que celle qui aurait pu être prononcée, car la banque a, depuis la découverte du manquement, amélioré ses contrôles internes et la formation de son personnel. En considération de cette amélioration de gouvernance, qui donne un gage de bon fonctionnement du système à l'avenir, le régulateur, à l'intérieur même de son système de sanction, adoucit celui-ci. The “Conseil économique, social et environnemental – CESE” (French Economic, Social and Environmental Council) expressed its approval of the “Stratégie nationale de développement durable SNDD” (new French National Strategy for Sustainable Development), on January 27 2010, which has been drawn up by the Government for the period 2009-2013.
