The Issing Commission, also called the Advisory Group on the New Financial Order, appointed by Chancellor Angela Merkel and directed by Otmar Issing, published a White Paper for the Toronto G20 Summit on June 21, 2010, detailing the criteria for a workable approach towards bank levies and bank restructuring. The Commission recommends two new regulatory measures: the introduction of a Systemic Risk Charge (SRC), and the implementation of a transparent bank resolution regime.

Der Expertengruppe Neue Finanzmarktarchitektur, die Issing-Kommission, unter Leitung der früheren EZB-Chef Otmar Issing, und von Bundeskanzlerin Merkel angestellt, hat am 21. Juni 2010 ein White Paper veröffentlicht. Dieser Bericht, der im Rahmen der G20 Gipfel in Toronto vorbereitet wurde, befasst sich mit der Kriterien für eine durchführsbare Einstellung zu einer Bankenangabe und zur Restrukturierung der Banken. Die Issing-Kommission schlägt zuerst vor, eine Bankenabgabe einzuführen, die sich an der Risikostruktur von Bankenaktivitäten orientiert. Dazu noch setzt sich die Expertengruppe Neue Finanzmarktarchitektur für die Einführung neuer und transparenter Regeln zur Restrukturierung von Banken.

As the previous cycles devoted to the general theme of Compliance and aiming to build a "Compliance Law", this cycle takes a particular aspect of this branch of the Law being built and developed, which was applied even before being conceived. Since pragmatism preceded or even prevailed, the theme chosen this year is: Les outils de la Compliance(Compliance Tools).
These conferences will be in French
These tools are very diverse, not only among themselves but according to the sectors in which they are deployed or according to the geographical areas in which they are applied. It is necessary to apprehend them by going beyond the description of the instrument literally shown, as the texts or the promoters show it, without immediately going up to too large generalities. For this reason, some conferences will focus on specific, well-identified mechanisms, such as risk mapping or alert. They may also consider how Compliance Law uses more general tools to achieve its goals, such as lawsuits, incentives or new technologies. This will make it possible to problematize more clearly perceptible difficulties in Compliance Law, such as the adequacy or inadequacy of the constraint in relation to the aims, the consideration or not of the legal and political geography, the articulation or not of the tools between them.
These various conferences will take place in several places, according to the part taken by the different university structures that this year contribute to the Journal of Regulation & Compliance (JoRC) for the realization of the cycle. The result will be two books, one in French: Les outils de la Compliance, the other in English: Compliance Tools.
This cycle of conferences about Compliance tools will begin in November 2019 and will last until June 2020.
The sessions will be held at the Conseil Economique, Social et Environnemental (CESE). Each session, which will be held (in French) from 5pm to 7pm, will give the stage to a panel of 3 to 4 speakers and will be concluded by a Q&A session with the audience.
The sessions will be held for seven weeks in a row, from October 5th to November 30th, 2016.
Germany adopted a law modifying its investment legal framework in application of the UCITS IV Directive (Directive 2009/65/EC) on December 15th, 2010. This law introduces three main changes, in taxation, in the framework of micro finance funds and in the supervisory regime for investments.

Esta lei introduz três mudanças principais, na área de impostos, no marco legal de fundos de micro finanças e no regime de supervisão dos investimentos.

Il 15 dicembre 2010, la Germania ha adottato una legge in materia di OICVM, applicando la quarta direttiva OICVM (la Direttiva 2009/65/CE). Questa legge introduce diversi cambiamenti, per quanto riguarda le imposte, in materia di fondi di micro finanza e nel controllo del regime degli investimenti.
News Summary: In its ordinance of 13th of October 2020, Conseil national du logiciel libre (called Health Data Hub), the Conseil d'Etat (French Administrative Supreme Court) has determined the legal rules governing the possibility to give the management of sensitive data on a platform to a non-europeans firm, through the specific case of the decree and of the contract by which the management of the platform centralizing health data to fight against Covid-19 has been given to the Irish subsidiary of an American firm, Microsoft.
The Conseil d'Etat used firstly CJEU case law, especially the decision of 16th of July 2020, called Schrems 2, in the light of which it was interpreted and French Law and the contract linking GIP and
The Conseil d'Etat concluded that it was not possible to transfer this data to United-Sates, that the contract could be only interpreted like this and that decree and contract's modifications secured this. But it observed that the risk of obtention by American public authorities was remaining.
Because public order requires the maintenance of this platform and that it does not exist for the moment other technical solution, the Conseil d'Etat maintained the principle of its management by Microsoft, until a European operator is found. During this, the control by the CNIL (French Data Regulator), whose the observations has been taken into consideration, will be operated.
We can retain three lessons from this great decision:
There is a perfect continuum between Ex Ante and Ex Post, because by a referred, the Conseil d'Etat succeed in obtaining an update of the decree, a modification of the contractual clauses by Microsoft and of the words of the Minister in order to, as soon as possible, the platform is managed by an European operator. Thus, because it is Compliance Law, the relevant time of the judge is the future.
The Conseil d'Etat put the protection of people at the heart of its reasoning, what is compliant to the definition of Compliance Law. It succeeded to solve the dilemma: either protecting people thanks to the person to fight against the virus, or protecting people by preventing the centralization of data and their captation by American public authorities. Through a "political" decision, that is an action for the future, the Conseil found a provisional solution to protect people against the disease and against the dispossession of their data, requiring that an European solution is found.
The Conseil d'Etat emphasized the Court of Justice of The European Union as the alpha and omega of Compliance Law. By interpreting the contract between a GIP (Public interest Group) and an Irish subsidy of an American group only with regards to the case law of the Court of Justice of European Union, the Conseil d'Etat shows that sovereign Europe of Data can be built. And that courts are at the heart of this.

United States Patent and Trademark Office, et al. case, before the Court of Appeal for the Federal Circuit, the US Department of Justice reversed a longstanding policy by declaring human genes ineligible for patents, because they are part of nature. This new position could have an enormous impact on the medical and biotech industries.
