The Issing Commission, also called the Advisory Group on the New Financial Order, appointed by Chancellor Angela Merkel and directed by Otmar Issing, published a White Paper for the Toronto G20 Summit on June 21, 2010, detailing the criteria for a workable approach towards bank levies and bank restructuring. The Commission recommends two new regulatory measures: the introduction of a Systemic Risk Charge (SRC), and the implementation of a transparent bank resolution regime.

Le Groupe d'Experts sur le Nouvel Ordre Financier, aussi appelé Commission Issing, mis en place par la Chancelière Angela Merkel et dirigée par Otmar Issing, a publié un livre blanc en préparation du sommet du G20 de Toronto le 21 Juin 2010. Ce document détaille les critères pour une approche fonctionnelle de la taxation et la refondation des banques. La Commission Issing recommande  de prendr deux mesures régulatoires: la mise en place d'une Taxe sur le Risque Systémique et l'introduction d'un système transparent de résolution bancaire.

Der Expertengruppe Neue Finanzmarktarchitektur, die Issing-Kommission, unter Leitung der früheren EZB-Chef Otmar Issing, und von Bundeskanzlerin Merkel angestellt, hat am 21. Juni 2010 ein White Paper veröffentlicht. Dieser Bericht, der im Rahmen der G20 Gipfel in Toronto vorbereitet wurde, befasst sich mit der Kriterien für eine durchführsbare Einstellung zu einer Bankenangabe und zur Restrukturierung der Banken. Die Issing-Kommission schlägt zuerst vor, eine  Bankenabgabe einzuführen, die sich an der Risikostruktur von Bankenaktivitäten orientiert. Dazu noch setzt sich die Expertengruppe Neue Finanzmarktarchitektur für die Einführung neuer und transparenter Regeln zur Restrukturierung von Banken.

La publicación del Libro Blanco “Criteria for a workable appraoch towards bank levies and bank restructuring” (Critero para un acercamiento factible hacia gravámenes bancarios y restructuración bancaria) el 21 de junio del 2010.

El Grupo de Expertos sobre la Nueva Orden Financiera, también conocido como Commission Issing, establecido por la Cancillera Angela Markel y dirigido por Otmar Issing, publicó un Libro Blanco para la Cumbre del G20 en Toronto el 21 de junio del 2010 en donde detalla el criterio para un enfoque factible sobre gravámenes bancarios y restructuración bancaria. La Comisión recomienda dos medidas regulatorias: la introducción a un Systematic Risk Charge (SRC – un cargo sistemático de riesgo) y la implementación de un régimen de transparencia bancaria.

The main theme of the eighth issue of The Journal of Regulation is that of Neutrality in systems of economic regulation in accordance with the conference that the Journal organized around this issue. This question is essential for a number of reasons: on one hand, companies sometimes demand that regulation be ‘neutral’ in the impact it has on their economic activities. On the other hand, States have other reasons for believing that regulation palliates market failure by using price-fixing to restore neutrality in certain sectors of the economy that are incapable of producing a fair market price. Still others believe that Regulation is not neutral because it intervenes against the neutrality of the market by imposing access to common goods, social policy concerns, etc.

Le principal thème du 8° numéro du Journal of Regulation est la question de la neutralité dans les systèmes de régulation économique, telle qu’elle avait été examinée dans le colloque annuel du Journal. Cette question est essentielle pour un certains nombres de raisons. D’une part, les entreprises exigent parfois que les régulation soient "neutres" dans les activités économiques des entreprises. D’autre part, les Etats peuvent avoir d’autres raisons d’adopter des régulations que de palier des défaillances de marchés, lesquelles sont incapables de produire des prix. Les Etats restaurent alors par leurs interventions une neutralité que les marchés ne peuvent pas techniquement engendrer. D’autres croient encore que la Régulation n’est pas neutre parce qu’elle intervient précisément contre la neutralité du marché, en imposant l’accès pour tous à des biens communs, décisions politiques adoptées pour des considérations de politique sociale.

Il tema principale di questo ottavo numero de The Journal of Regulation è la Neutralità nei sistemi di regolazione economica in linea con la conferenza organizzata dalla rivista relativamente a tale tema. Tale tema riveste un’importanza fondamentale per diverse ragioni: da un lato, le società talvolta richiesto che tale regolazione sia neutrale rispetto all’impatto provocato sulle loro attività economiche. Inoltre, gli Stati hanno diverse ragioni per considerare che la regolazione riduca il rischio di disfunzioni del mercato usando il potere di fissazione del prezzo garantendo così la neutralità che certi settori sono incapaci di raggiungere in quanto incapaci di stabilire un prezzo equo di mercato. Infine, altri ritengono che la Regolazione non sia neutrale in quanto interviene sulla neutralità del mercato ed impone l’accesso ai beni comuni, obiettivi di politica sociale, ecc.

El tema principal del 8º volumen del Journal of Regulation es a cuestión de la neutralidad en los sistemas de regulación económica, tal como ha sido examinada en coloquio anual del Journal. Esta cuestión es esencial por varias razones. De una parte, las empresas a veces exigen que las regulaciones sean “neutras” en las actividades económicas de las empresas. Por otra parte, los Estados pueden tener otras razones para adoptar regulaciones , a parte de lidiar con los fallos de los mercados, los cuales son incapaces de producir precios. Los Estados restauran, a través de sus intervenciones, una neutralidad que los mercados no pueden engendrar. Algunos siguen pensando que la Regulación no es neutra porque interviene precisamente en contra de la neutralidad del mercado, al imponer el acceso universal a bienes comunes, decisiones políticas adoptadas por consideraciones de política social.

الموضوع الرّئيسي للطبعة الثامنة لمجلة التنظيم هو الحياد في النّواضم الاقتصادية وفقا للمؤتمر أللذي انتظم حول هذه القضية. هذا السّؤال ضروري لأسباب متعدّدة : أوّلا، الشّركات تطلب في بعض الأحيان "محايدة" اللّوائح في تأثير على أنشطتها الاقتصادية. من ناحية أخرى، فإن الدول الأخرى يعتقدون أن التّنظيم يخفّف من فشل السوق بمساعدة استخدام التسعير من أجل استعادة الحياد في القطاعات الاقتصاد غير القادرة على إنتاج سعر السوق العادل. لا يزال البعض يعتقد أن التنظيم ليس محايدا لأنّه يأتي ضدّ الحياد السوق عن طريق اشتراط الحصول على الملكية المشتركة، والمخاوف من السياسة الاجتماعية، الخ

L'Institut Montaigne a rendu publics les travaux menés par un groupe de travail dirigé par Monsieur Michel Pébereau sur la question de l'équilibre entre d'une part la régulation financière, dont la nécessité est posée, articulée à la supervision bancaire, dans la perspective d'un marché européen intégré et dans un contexte de concurrence mondiale, et d'autre part la croissance dont chacun sait qu'elle est la condition première de la politique de l'emploi, du redressement industriel, etc. A partir d'une reconstitution historique et technique, le rapport établit 20 propositions précises, tendant à établir et renforcer cet équilibre, la nécessité de régulation ne devant pas prendre le pas sur la croissance ni vice-versa.

Corporate officers that had provided financial markets with false information, as well as their auditors, were under investigation by the Autorité des Marchés Financiers (AMF—French financial markets authority) for failure to provide information. On March 31, 2011, the AMF’s Enforcement Commission punished the corporate officers, but decided to innocent the auditors, on the grounds that they had obeyed professional standards.

In France, The "Autorité de la Concurrence" -ADLC (French Competition Authority) may deliver opinions. An association of importers of petroleum products asked it his opinion on statistics of sales made by each warehouse of petroleum products on each area of the national territory, published monthly. By notice on May 15, 2012, the Authority replied that such statistics on each operator are welcome because they generate transparency on the retail market, although it should be that statistics cover all of the territory and are published every six months or annually.

General presentation of the Conference

After having examined various specific tools, such as Risk mapping or Incentives, and before tackling others such as those falling under a "Compliance by Design", it also deserves to be examined with some distance in its claim to be the solution to any compliance issue, it is worth looking at how we measure the effectiveness of all these Compliance Tools. Indeed, since all techniques are "tools", they only take on meaning with regard to a purpose that they must effectively achieve. This effectiveness must be measured, and this immediately in Ex Ante, the company constantly having to show the effectiveness of the performance of the Compliance tools.

But at the same time as the standards proliferate, the discourses multiply, the commitments are made, the techniques for measuring the effectiveness of the whole seem quite weak. The subjects of law obliged by Compliance obligations or freely wishing to achieve the systemic or common good goals targeted by Compliance do wish to have these measurement instruments. But they seem still little built, often declarative or discursive, or too mechanical. Therefore, is it starting from the goal of Compliance  that we must measure the effectiveness of the Compliance tools, without by this way transforming the tasks weighing (willingly or by force) on operators in obligation to result? Or is it by staying upstream, by a single "conformity" to what is asked of them, as behavior and as structural organization, that companies show that they have effectively fulfilled their task, without worrying about the effects products about the reality, this reality that those who designed the Compliance norms and standards had in mind?

This question has major implications in terms of burden of proof and responsibility, involving organizations which place Trust, the heart of Compliance, rather in technological instruments - only but so efficiency connecting data - or rather in people with a sense of common good. This question is now open.
