Prudential rules on the own funds of banks adopted by the Basle Committee are biding as soon as they will be transposed in a binding legal text. The new rules of Basel III must take the force of a European directive. This gives rise to a new discussion, nor between the central bank governors (as in Basel), but between Finance Ministers of the European Union member states, in Brussels. On this occasion, each State defends the interest of its banks; the rule advocated by him corresponds to its banking structure or its type of banking business. In any case, the banks, anticipating the application of Basle III, have already integrated the prudential requirements in their accounts, hoping that their State will preserve it.

Central banks have a decisive role on the markets and the question of their accountability is raised. This is particularly true concerning the powerful Fed which applies a genuine economic policy. For the moment, a kind of observatory made remarks to the benefit of the Congress on it. The House of Representatives voted on 8 August 2012 a text that increases the audit of this policy determined by the single Central Bank. If the Senate also voted this text, then comes a law so that the Central Bank, although independent will be more accountable . Thus the fundamental couple in regulation, namely "independence - accountability" will be more respected.

Breaking news

As in all systems of telecommunications in the world backed to a liberalized market, the one organized in India foresees the granting of licences to operators. It is the Government that allocates licenses, but it is the regulator (the Telecom Regulatory Authority of India - TRAI) that provides the financial terms to set the price of the licenses. On May, 2 2012, the regulator has proposed to use the auction method. The association of operators protested. This method led indeed generally priced higher than other methods of pricing of licenses assigned.

Access is a key concept in regulation since only a competitive market allows access for all to becom offerers and applicants. This is why regulations and regulators intervene ex ante to force access to natural monopolies, such as transport networks, for the benefit of other operators. Thus, Regulation compensates for market failures by imposing access. In addition to these access imposed for technical reasons, the Politics can still intervene to force for all access to common goods, such as culture, health, education, referring to the Social Contract. The foundation, political, is different.

Summary of the news:

On 22nd of September 2017, Transport of London (TFL), London Transport Regulator, refused to renew the licence, granted on 31st of May 2012 for 5 years, authorizing Uber to transport people because of criminal offenses committed by Uber's drivers. On 26th of June 2018, The Westminster Court prolonged Uber's licence for 15 months under the condition that the platform prevent the reproachable behaviors of its drivers. After these 15 months, the TFL refused once again to prolonge Uber's licence because of the persistence of aggressions against passengers. Uber, once again, contest this decision before the Westminster Court. 

In a decision of 28th of September 2020, the Court observes that during the 15 months, the platform implemented many measures to prevent aggressions, that the level of maturity of these measures has improved over time and that the number of offenses was reduced over the period (passing from 55 in 2018 to 4 in 2020). The Court estimated the the implementation of this actions is sufficient to grant a new licence to Uber. 

We can learn three lessons from this decision: 

  1. The Compliance obligation is not a result obligation but a mean obligation, which means that it is not reasonable to expect from a crucial operator (Uber, for instance) that it prevent every cases of agression but that it is salient to judge it on the effort it deploys to try to be closer to this ideal situation. Moreover, the crucial operator must be proactive, that is going away from the figure of passive subject of Law who apply measures enacted by the regulator in terms of fighting against aggressions to be an actor of the research of the best way to fight abusive behaviors, internalizing this "monumental goal. 
  2. The judge appreciates the violation committed by those whose the firm is responsible "in context", that is evaluates the concrete situation in a reasonable way. 
  3. It is the judge who decides in last resort and like the crucial operator, it must be reasonable.

What is called the "Libor" is a contraction of "London InterBank Exchange Rate". Each morning, the banks reported Libor rates and all of the exchanges are backed with these statements. It is therefore the confidence that we make to them that holds the system. In a declarative system, it was easy for the Barclays Bank to report an inaccurate Libor, upward or downward, according to trade that it wanted to do. This is legally of course a price manipulation, which was sanctioned by the "Financial Securities Authority - FSA" on June 27, 2012, inflicting Bank fined nearly £ 60 million. But it is especially throughout the system of credibility of this Bank, and banks, which is undermined, since everything is based on the statements. We understand that therefore all managers are laid off, etc. Will that be enough to keep a system purely declarative?

The Algerian population is heavily access the mobile phone. Operators had designed special offers, including the terminal itself and a "pre-paid" said contract, the subscriber having a consumption credit, thereby decreasing by the use. The Algerian Telecommunications regulator, by a decision of March, 7 2012, has purely and simply prohibits this type of offer, while she oversees other type of promotional offers. This prohibition is criticized in that it breaks the dynamics of the market, 95% of the customers do not have the opportunity to access to another service than prepaid subscription and being excluded from access to the mobile terminals. It is advocated by others, that only subscriptions giving rise to payment after the use correspond to a mature market, with creditworthy customers and more complex services. The regulator did not intend to speak on this issue.
