Thematic Report (Energy): The French energy regulator publishes its first unfavorable opinion regarding the government’s proposed natural gas tariffs for residential customers.

The Commission de Régulation de l’Energie (CRE — French energy regulator) published an opinion “regarding the draft executive order regarding the regulated tariffs for natural gas publicly distributed by GDF Suez.” This non-binding opinion was published on September 29, 2011, and claims that it is not acceptable for the Government to leave natural gas prices unchanged because these prices do not cover GDF Suez’s costs and symmetrically prevent newcomers from competing with it.

Relazione tematica (Energia): L’autorità di regolazione francese nel settore dell’energia ha reso pubblica il suo primo parere sfavorevole a proposito delle tariffe del gaz proposte dal governo per le utenze residenziali


La Commission de Régulation de l’Energie (CRE – l’autorità francese di regolazione nel settore dell’energia) ha reso pubblico un parare « riguardante la bozza di proposte di tariffe per il gaz naturale distribuito da GDF Suez ». Questo parere non vincolante è stato pubblicato il 29 settembre 2011 e afferma che non è possibile per il Governo di lasciare immutati i prezzi del gas naturale poiché questi prezzi non coprono i costi di GDF Suez e, al contempo, impedisce ai nuovi operatori di competere con tali costi.

The “Conseil économique, social et environnemental – CESE” (French Economic, Social and Environmental Council) expressed its approval of the “Stratégie nationale de développement durable SNDD” (new French National Strategy for Sustainable Development), on January 27 2010, which has been drawn up by the Government for the period 2009-2013. This national strategy is to become the tool for establishing a new model of economic development.

JoRC

This scientific manifestation is placed under the scientific responsibility of Marie-Anne Frison-Roche. It is organized by the Journal of Regulation & Compliance (JoRC).

It constitutes the inaugural colloquium of the cycle of colloquia in 2021 on the general topic Compliance Jurisdictionalisation.

 

 

The work will then be incorporated into the two books La juridictionnalisation de la Compliance and Compliance Jurisdictionalization which will be published in the Regulations & Compliance series, co-edited by the JoRC with Dalloz for the book in French and with Bruylant for the book in English.

This colloquium will be held in Paris in 2021.

 

Presentation of the topic: Because Compliance Law is the extension of Regulatory Law, it is experiencing the same movement of Juridictionnalisation. First of all conceived as the goal of protecting systems and people, even if they seem beyond reach, this has led to the establishment of private companies as judges of themselves, to be structurally the judges and judged, those who act and those who observe.  The duty of vigilance has increased this transformation. As in Regulatory Law, which is an Ex Ante branch of Law, the procedure, which is an Ex Post branch of Law, governs the functioning of companies, transfiguring Company Law under the term "governance".

The shock and transformation once received by Administrative Regulatory Authorities has been heightened by the fact that companies have been further seized by the repressive Courts on the one hand and by an American repressive Law on the other hand, two different cultures. There are therefore many technical difficulties that must first be identified and formulated and then resolved. The easiest is in a first step to ask the following questions : Why? Who? How? When? Where? Toward What?

The September 8th 2010 decision of the European Court of Justice rules that any national law on gambling restraining freedom of establishment and freedom to provide services, if not consistent and systemic in its purpose, violates EU Law.

La Corte Europea de Justicia restringe a los Estados Miembros la habilidad de dificultar la libre provisión y establecimiento de servicios de juego en su territorio nacional.

El 8 de septiembre del 2010, una decisión de la Corte Europea de Justicio juzga que cualquier ley nacional sobre los juegos que restrinjan la libertad de establecimiento y la liberad de proveer servicios, a menos de que sea consistente y sistémica en su propósito, viola la Ley de la Unión Europea.

 Relazione tematica (scommesse): La Corte di giustizia europea riduce la possibilità per gli Stati membri di ostacolare la libera circolazione ed il libero stabilimento dei servizi di scommesse sul proprio territorio.

La Corte di giustizia, con una sentenza dell’8 settembre 2010, ha deciso che ogni legislazione nazionale in materia di scommesse che riduce il diritto di libero stabilimento e la libera prestazione di servizi viola il diritto europeo, qualora tale legislazione non contribuisca a limitare l’attività di scommesse in maniera coerente e sistematica.

The French Act of 1 February 2012 "to strengthen the ethics of sport and sports rights" has sought to resolve the issue of the use of short excerpts from sports other than broadcast rights holders. Prior to this, only a code of conduct existed, the uncertainty remaining, and also about the dimension of the extract and the support of the extract. The Act is now related to the extract in any medium, including the Internet, and gives the power to establish specific rules to the Conseil Supérieur de l'audiovisuel (CSA)- (French audiovisual regulatory). Furthermore, the Act of May 17, 2011 has extended the right to free diffusion in any event a great interest to the public. The Conseil Supérieur de l'audiovisuel (CSA) – (French audiovisual regulatory) has opened on April 4, 2012, a public consultation. It will be closed on 18 May.
