Breaking news

The Department of Justice of the United States takes position for legislation intra-State concerning online gambling, other than sports betting. State laws are currently restrictive.

In the Unites States, the Federal Act, the Interstate Wire Act, is now performed by the Department of Justice as that only prohibiting sports betting and not poker online. In addition, States have to make arrangements if they want to liberalize the game of poker online. In February 2012, there is that many States have explicitly maintained the ban, only having liberalized and permits issued for Nevada.

The French Act of October 22, 2010 establishes a Conseil de Régulation Financière et du Risque Systémique (Council of Financial Regulation and Systemic Risk), chaired by the Minister of the Economy. It is composed of the Governor of the Bank of France (who is also chairman of the Autorité de Contrôle Prudentiel ( Prudential Supervision Authority), its Vice-President, and the Presidents of the Autorité des Marchés Financiers ( Financial Markets Authority) and the Autorité des Normes Comptables (Authority of Accounting Standards), and three other competent individuals.

Seine Mitglieder sind der Präsident der Banque de France (die französische Zentralbank) (der auch Vorsitzende der Autorité de Contrôle Prudentiel  (Aufsichtbehörde) ist), der Vizepräsident der Banque de France, und die Präsidenten der Autorité des Marchés Financiers (die Finanzdienstleistungsaufsichtsbehörde), der Autorité des Normes Comptables (die Rechnungslegungsstandardsbehörde) und drei andere fachkundigen Menschen.

The Federal Communications Commission (FCC) announces that it will reclassify broadband Internet service as a Telecommunications Service, in order to overcome the ruling by the United States Court of Appeals for the District of Columbia on April 6, 2010, which found that the FCC’s approach to network neutrality lacked sufficient legal basis.

II-2.9: The Comptroller and Auditor General of India reveals gross irregularities in the attribution process of mobile telephone licences and allocation of mobile telephone frequencies.

Main information

On November 16, 2010, the Comptroller and Auditor General of India made public a 96-page report (n° 19 of November 2010) in which it revealed gross irregularities suggesting favoritism in procedures for licensing mobile telephone operators and attributing frequencies from the mobile telephone spectrum over a period stretching from April 2003 to October 2009, on behalf of the Ministry of Communications and Information Technology. Following the revelation of this report, the Minister for Telecommunications, Andimuthu Raja, resigned from his post on the suggestion of the Prime Minister of India.

Estonia is pursued by the European Commission, in that it makes no distinction its activities as regulator and operator on telecommunications.

In Estonia, State owns the company Levira Ltd., which operates telecommunications. Meanwhile, the Minister for Economic Affairs which assigns and manages the radio frequencies, numberings and ensures the functioning of the universal service. But a principle of regulation prohibits the cumulation by the state of the quality of regulator and the quality of operator. This is why the European Commission opened an infringement procedure to the right of the European Union against the Estonia 1 July 2012 and asked by a reasoned opinion, to separate clearly its two activities, to ensure the required impartiality attached to the exercise of the powers of regulation.

On 18 June 2012, the French Senate published an information report on the operation, the methodology and the credibility of the rating agencies.

After an assessment critical rating agencies, on their role in the crisis, on the concentrated nature of the market of the notation, the report published on 18 June 2012 by the French Senate proposes a series of action to "detoxify" the system. It indicates with the same voluntarism that there is no fatality, it proposes that central banks resumed their role more firmly, that the States publish a call for tenders to encourage the emergence of a new European private actor to which the methodology will be imposed, we diversified the notes, we disciplined " ex-post" agencies by the game of responsibility, that we loosened the power of the agencies on the democratic entities, including States, that can prevent conflicts of interest.
