The Autorité de régulation des communications électroniques et des postes (ARCEP - French regulator of Telecommunications and Posts) granted a licence for a new entrant, Free, what was widely challenged. This allocation was made in exchange f a number of commitments of recipient, especially towards the virtual mobile networks operators (MVNO). Indeed, FREE must allow them to use its facilities and its authorisation, the satisfaction of the commitment which has the effect of fostering competition in the mobile phone market. However, some virtual mobile networks operators (MVNO) complained that Free would not respect its commitments in that the offer of host that FREE have made in exchange, of a higher price of retail price, which is contrary to the principle of opening up competition. The regulator opens proceedings against FREE.

The Direction générale de la concurrence, de la consommation, et de la repression des fraudes (DGCCRF – The French Directorate General for Competition, Consumer Affairs, and Repression of Fraud) organized a Competition Workshop on the theme “Transportation and Competition” that took place at the Ministry of Economics, Finance, and Industry, in Paris, on December 16, 2010. These workshops, which are half-day conferences on a given theme, have been organized by the DGCCRF multiple times a year on various themes since 1994. This event was chaired by Anne Wachsmann, a lawyer at Linklaters, and Christophe Lemaire, a teaching assistant at the Law School of the Sorbonne, and a lawyer at Ashurst.

La Direction générale de la concurrence, de la consommation, et de la répression des fraudes a organisé un Atelier de la Concurrence sur le thème "Transports et Concurrence" qui a eu lieu au Ministère de l'Economie, des Finances et de l'Industrie à Paris, le 16 décembre 2010. Ces ateliers, qui sont des colloques d'une demie-journée sur un thème donné, sont organisés par la DGCCRF plusieurs fois par an depuis 1994. Cet atelier a été présidé par Maître Anne Wachsmann, avocat chez Linklaters, Paris, et Maître Christophe Lemaire, maître de conférences à l'Ecole de  Droit de la Sorbonne et avocat chez Ashurst, Paris.

Die Direction générale de la concurrence, de la consommation, et de la repression des fraudes (DGCCRF – die französische Hauptleitung für Wettbewerb, Konsumierung und Betrugsahndung) hat ein Wettbewerbsarbeitstreffen um dem Thema « Verkehr und Wettbewerb » organisiert. Er fand statt im Gebäude des Minsisteriums für Wirtschaft, Finanz und Industrie in Paris am 16. Dezember 2010. Solche Arbeitstage, die eigentlich ein halbes Tag lang dauern, wurden seit 1994 bei der DGCCRF mehrmals im Jahr organisiert. Diese Konferenz wurde von Anne Wachsmann, Rechtsanwältin für Linklaters, und Christophe Lemaire, wissenschaftlicher Mitarbeiter an der Sorbonner Rechtsschule, und Rechstanwalt für Ashurst, geleitet.

La Directiva general francesa para la competencia, asuntos del consumidor y la represión del fraude organiza un Taller de Competencia sobre el tema de “Transporte y Competencia.”

La Direction générale de la concurrance, de la consommation, et de la repression des fraudes (DGCCRF - Directiva general francesa para la competencia, asuntos del consumidor y la represión del fraude) organizó un  Taller de Competencia sobre “Transporte y Competencia” que se llevó a cabo en el Ministerio de Economía, Finanza e Industria en Paris el 16 de diciembre del 2010. Estos talleres, que son de una duración de medio día, han sido organizados por el DGCCRF en múltiples ocasiones a lo largo del año sobre varios temas desde 1994. Este evento fue dirigido por Anne Wachsmann, una abogada de Linklaters, Cristophe Lemaire, un profesor asistente en la Universidad Sorbonne, y un abogado proveniente de Ashurst.

Questi convegni, delle mezze giornate di conferenza su un tema predeterminato, sono stati organizzati diverse volte l’anno dalla DGCCRF su diversi temi sin dal 1994. Questo convegno era presieduto da Anne Wachsmann, avvocato presso lo studio Linklaters, e Christophe Lemaire, professore dell’Ecole de Droit della Sorbona, e da un avvocato di Ashurst.

Sectorial Analysis

As soon as Regulation assumes independence of the operator who manages the essential infrastructure, ex ante conditions of such independence must be met.
 
Europe doesn't require legal autonomy of the essential infrastructure manager, probably because such autonomy, it would be both too ask the Policy, which may want more integrated organizations as soon as public transportation is a mix of public policies and that to public funds are used. But it would also be too little to ask the Policy because no matter the legal autonomy, the key is the real independence of the manager, that is under the control of the Regulator.
 
The Loi portant réforme ferroviaire (Railway Reform Act) of August 4, 2014 has made the integration of the company that manages the rail network, which the new name is SNCF Réseau (SNCF Network) in a public group, which also includes the SNCF, public transportation operator, in competition with new entrants in a newly opened sector to competition.
The Competition Authority in its opinion of 4 October 2013 had expressed reluctance towards the bill, to the influence that such corporate organization offers to the public operator, to the detriment of its competitors and the opening of the railway sector to competition.
The critical tone increases with the Opinion of 6 January 2015 relatif à des projets de décrets pris pour l'application de la loi portant réforme ferroviaire (on draft orders made for the purposes of Railwayl Reform Law).
The Competition Authority issues its opinion as a real essay on what should be the Regulation of the railway sector through the "governance" of the network manager. Indeed, the first part of the opinion relates to "the independent management of railway infrastructure" while the second focuses on the integration of railway network in the public group built par the law. The third part of this Opinion draws conclusions to measure whether we can consider that the Autorité de Régulation des Activités Ferroviaires (French Regulatory Authority of Railways Activities) shall have the capacity to ensure this independence by governance or not.
 
This review, in its construction itself, demonstrates the dialectic between Regulation and Governance (I), which is an observation and stresses the role of the regulator in the effectiveness of governance (II), which is more a question .

This scientific event is placed under the scientific responsibility of Marie-Anne Frison-Roche and Jean-Baptiste Racine. It is organized by the Journal of Regulation & Compliance (JoRC) and by the Centre de recherche sur la Justice et le Règlement des Conflits (CRJ)  of the  Panthéon-Assas (Paris II) University, with the active support of the International Chamber of Commerce ICC.

This event is the third colloquium of the 2021 colloquia cycle around the general theme of Compliance Jurisdictionalisation.

 

 

 

The interventions will be then transformed into a chapter in the books: contributions in the 📕 La Juridictionnalisation de la Compliance  , to be published the Regulation & Compliance series ries, jointly published by the Journal of Regulation & Compliance (JoR)C and Dalloz 

📘Compliance Jurisdictionalisation, 📚   to be published in the Compliance & Regulation Series , co published by the Journal of Regulation & Compliance (JoRC) and  Bruylant.

Presentation of the theme: 

The arbitrator is the ordinary judge of international trade. It was natural that he or she encountered Compliance: by definition Compliance Law takes hold of the whole world and follows the paths of international trade while it can only be deployed with the help of institutions which, by nature are spreading around the world and need authorities like the Courts.

The conference is based on the already perceptible connection points between Compliance and Arbitration to better identify what is emerging for tomorrow: contradiction or convergence between the two; weakening or consolidation. We are already seeing the impact that Compliance can have on the arbitrator's treatment of corruption or the consideration of money laundering. More generally, where do we stand with the arbitrator's knowledge of the many technical issues related to compliance? Beyond these, will the courts and arbitrators be able to achieve the goals, themselves new, sometimes monumental, pursued by Compliance Law?

Through this joint exploration of these avenues, the fate of compliance clauses inserted in contracts, the relevance in the matter of private codes of conduct, etc. will be examined.

Tomorrow, as of today, is the arbitrator a full and complete judge of Compliance Law?
