The main theme of the eighth issue of The Journal of Regulation is that
of Neutrality in systems of economic regulation in accordance with the
conference that the Journal organized around this issue. This question
is essential for a number of reasons: on one hand, companies sometimes
demand that regulation be ‘neutral’ in the impact it has on their
economic activities. On the other hand, States have other reasons for
believing that regulation palliates market failure by using price-fixing
to restore neutrality in certain sectors of the economy that are
incapable of producing a fair market price. Still others believe that
Regulation is not neutral because it intervenes against the neutrality
of the market by imposing access to common goods, social policy
concerns, etc.

Le principal thème du 8° numéro du Journal of Regulation est la question de la neutralité dans les systèmes de régulation économique, telle qu’elle avait été examinée dans le colloque annuel du Journal. Cette question est essentielle pour un certains nombres de raisons. D’une part, les entreprises exigent parfois que les régulation soient "neutres" dans les activités économiques des entreprises. D’autre part, les Etats peuvent avoir d’autres raisons d’adopter des régulations que de palier des défaillances de marchés, lesquelles sont incapables de produire des prix. Les Etats restaurent alors par leurs interventions une neutralité que les marchés ne peuvent pas techniquement engendrer. D’autres croient encore que la Régulation n’est pas neutre parce qu’elle intervient précisément contre la neutralité du marché, en imposant l’accès pour tous à des biens communs, décisions politiques adoptées pour des considérations de politique sociale.

Il tema principale di questo ottavo numero de The Journal of Regulation è la Neutralità nei sistemi di regolazione economica in linea con la conferenza organizzata dalla rivista relativamente a tale tema. Tale tema riveste un’importanza fondamentale per diverse ragioni: da un lato, le società talvolta richiesto che tale regolazione sia neutrale rispetto all’impatto provocato sulle loro attività economiche. Inoltre, gli Stati hanno diverse ragioni per considerare che la regolazione riduca il rischio di disfunzioni del mercato usando il potere di fissazione del prezzo garantendo così la neutralità che certi settori sono incapaci di raggiungere in quanto incapaci di stabilire un prezzo equo di mercato. Infine, altri ritengono che la Regolazione non sia neutrale in quanto interviene sulla neutralità del mercato ed impone l’accesso ai beni comuni, obiettivi di politica sociale, ecc.

El tema principal del 8º volumen del Journal of Regulation es a cuestión de la neutralidad en los sistemas de regulación económica, tal como ha sido examinada en coloquio anual del Journal. Esta cuestión es esencial por varias razones. De una parte, las empresas a veces exigen que las regulaciones sean “neutras” en las actividades económicas de las empresas. Por otra parte, los Estados pueden tener otras razones para adoptar regulaciones , a parte de lidiar con los fallos de los mercados, los cuales son incapaces de producir precios. Los Estados restauran, a través de sus intervenciones, una neutralidad que los mercados no pueden engendrar. Algunos siguen pensando que la Regulación no es neutra porque interviene precisamente en contra de la neutralidad del mercado, al imponer el acceso universal a bienes comunes, decisiones políticas adoptadas por consideraciones de política social.

Summary of the news
The Cour de Cassation (French Supreme Judicial Court) made a decision on 19th of December 2019 about a case concerning a refusal to communicate his mobile phone's unlock code to the police while the police found him with a significant quantity of narcotic and a lot of cash and that there was a certain probability that this mobile phone get proofs of culpability of its owner. The individual was indicted not for narcotic trafficking but for not having communicate its unlock code which constitute an offense to article 434-15-2 of code pénal, from the loi du 3 juin 2018 renforçant la lutte contre la criminalité organisée, et le terrorisme et leur financement (law reinforcing organized crime, terrorisme and their financing).
The accused invokes before the court its right to not incriminate oneself. Indeed, the configuration face to policemen was such that if he refused to communicate its unlock code, he will be punished because of this obligation to communicate his code and that if he accepted, he will also be sanctioned because of the proofs contained into the mobile phone. Such a configuration therefore offered him no alternative to confessing, which is contrary to the European Convention on Human Rights and to European and national jurisprudence.
Face to such a case, the Cour de Cassation chose to segment the information and proposed the following solution: if the researched information cannot be obtained regardless of the suspect willingness, it is not possible to constraint this person to communicate this information without violating its procedural rights, but if the information can be obtained regardless of the suspect willingness then the individual is obliged to communicate his code. In the current case, as it was possible for policemen to obtain information contained in the phone by technical means, longer but existent, then the refuse of communication of the unlock code by the suspect constitute an obstruction that should be sanctioned.
Such a decision is an exemple of the conciliation by the judge of two fundamental but contradictory "monumental goals" of Compliance Law: transparency of information towards public authorities and very sensible personal data protection.

Summary of the news
Through a decree of 31st of August 2020, the government created a national service, the "Pôle d'expertise de la régulation numérique" (digital regulation expertise pole). It has to furnish to State services a technical expertise in computer science, data science and algorithm processes in order to assist them in their role of control, investigation and study. The aim is to favor information sharing between researchers and State services in charge of regulating digital space.
As its acronym indicates, this pole of expertise aims to represents constance in a changing world. Moreover, more than being a national service, this organism must adopt a transversal dimension, its creation decree being signed by the Prime Minister, Minister of Economy, Minister of Culture and Minister of Digital Transition. The creation of such a pole shows the awareness of the government of the importance of technical competency in the regulation of digital space and of the necessity to centralize these expertises in one organ.
However, as the decree indicates, this pole of expertise could be consulted only by "State services", that excludes regulators which are independent from the State and which could put the pole in conflict of interest, and courts even if they are supposed to play a central role in the regulation of digital space and even if they are allowed to ask the advice of the regulator about some cases. But if regulators cannot size the pole, to whom does it benefit except the legislator and a few officials?
It would therefore have been better for this pole of expertise to be placed under the direction of regulatory and supervisory bodies, which would have enabled it to be able to be consulted both by regulators and by judges, both of whom are key players in digital regulation.

Europe is definitely the zone of the world in which the protection of persons is thought.
Elle le fait par des textes, dont le très fameux Réglement adopté en 2016 relative à la protection des personnes physiques à l'égard du traitement à caractère personnel et à la libre circulation de ces données, dit "RGPD", recopié par exemple en Californie par la loi du 12 juillet 2018, par des initiatives nationales, comme la prochaine loi française contre les discours de haine dans l'espace numérique, par de nombreuses études et rapports - le droit souple étant aussi importante que le Droit pénal en Droit de la Compliance, mais encore par des décisions de justice.
Europe does this by texts, including the very famous Regulation adopted in 2016 relating to the treatment of personal data for their free circulation and the protection of peope concerned by them ( known as General Data Protection Regulation - GDPR ), copied for example in California by the Act of 12 July 2018, by national initiatives, such as the next French law against hate speech in the digital space, by numerous studies and reports - Soft Law being as important as Criminal Law in Law of Compliance system -, but also by court decisions.
Indeed, judicial decisions were at the origin of the movement of the person protection, with the creation of a "right to be forgotten" by the 2014 Google Spain decision of the Court of Justice of the European Union.
The judgment of the CJEU on 29 July 2019, Fashion ID, is just as important. Like the previous one, it clearly settles an essential question: who must police consents in the digital space?
And the answer is: all the digital players who benefit from it.
As a result, there is an "intermesh" (on this notion which is the future of Compliance Law in the digital world, see Frison-Roche, M.-A., The contribution of Compliance Law in the Governance of Internet, 2019 ).

► Presentation of the topic : Two movements intersect: firstly, what is commonly referred to as the "contractualisation of justice", an image that nevertheless refers to the inclusion of truly contractual techniques in procedural proceedings, and secondly, through the Compliance Juridictionalisation, the emergence of Systemic Litigation, which by transitivity bears the hallmarks of Compliance Law itself.
Furthermore, compliance techniques are increasingly giving way to contractual mechanisms, either through "compliance contracts" or through "compliance clauses". This therefore gives rise to contractual disputes. These are also influenced by Compliance Law, notably its norative Monumental Goals, albeit indirectly rather than directly.
Thus, in various new ways, a new field of "contractual litigation involving compliance" is emerging. This field involves procedural and jurisdictional aspects, which will be examined during this event.
Firstly, it is necessary to define this contractual dispute involving compliance (I), which has only recently emerged, because although we have always been familiar with contractual disputes on the one hand, dispute over regulation and compliance in the second instance, their entanglement with the contractualisation of justice is new. This may even come as a shock, in that Compliance Law, because it is not at all simply an obligation to obey applicable regulations, carries with it systemic ambitions for the future and thus finds itself, through contracts, brought before judges who are more accustomed to disputes between two individual parties.
This opens up the topics of judges hearing cases and judges of nature (II), the parties to the dispute and the parties to the proceedings (III), procedural treatment (IV), judgement and its enforcement (V).
