► Presentation of the topic :  Two movements intersect: firstly, what is commonly referred to as the "contractualisation of justice", an image that nevertheless refers to the inclusion of truly contractual techniques in procedural proceedings, and secondly, through the Compliance Juridictionalisation, the emergence of Systemic Litigation, which by transitivity bears the hallmarks of Compliance Law itself.

Furthermore, compliance techniques are increasingly giving way to contractual mechanisms, either through "compliance contracts" or through "compliance clauses". This therefore gives rise to contractual disputes. These are also influenced by Compliance Law, notably its norative Monumental Goals, albeit indirectly rather than directly.

Thus, in various new ways, a new field of "contractual litigation involving compliance" is emerging. This field involves procedural and jurisdictional aspects, which will be examined during this event.

Firstly, it is necessary to define this contractual dispute involving compliance (I), which has only recently emerged, because although we have always been familiar with contractual disputes on the one hand, dispute over regulation and compliance in the second instance, their entanglement with the contractualisation of justice is new. This may even come as a shock, in that Compliance Law, because it is not at all simply an obligation to obey applicable regulations, carries with it systemic ambitions for the future and thus finds itself, through contracts, brought before judges who are more accustomed to disputes between two individual parties.

This opens up the topics of judges hearing cases and judges of nature (II), the parties to the dispute and the parties to the proceedings (III), procedural treatment (IV), judgement and its enforcement (V).

Risk Mapping is defined as a process of identifying, evaluating and prioritizing risks: it is an integral and fundamental part of an effective global strategy for managing these risks. 

As a central tool for Compliance, this approach may not be radically new, but the Risk Mapping Technique is now renewed and sometimes compromised by the emergence of new Risks, often due to their new mutiform nature. Moreover, the primacy of the new pair of "Political Risks/Compliance Risks" tends to increase the vulnerability of organizations obliged by new legal provisions to draw up these maps, whereas these tools must also protect these organizations. 

Before discussing it with the audience, the speakers will explain through their experience the place of this tool in Compliance, by looking at how Risk Mapping is articulated with the logic of value creation through risk-taking, inherent in entrepreneurial and political action. This good understanding is not only essential for the company, but also for the administrative and judicial authorities which control or sanction firms.

The European Commission has published its institutional architecture of the Union Bank, which is being built in Europe. The primary role is entrusted to the European Central Bank. The ECB shall have power to issue licenses to the 6000 banks acting in the euro area. This institution will supervise to ensure compliance and liquidity. It will restore compliance if necessary. It will have power to impose sanctions, ranging from fines to withdrawal of approval. Thus, institutional reform leads to an extreme centralization of power, national authorities no longer as relays

Ofcom (The Office of Communications), Britain’s audiovisual and telecommunications regulatory authority, revoked Teletext Limited’s public teletext license on January 29, 2010 and fined Teletext Ltd. £225,000 on May 27, 2010, for having unilaterally ceased broadcasting of teletext services on December 15, 2009, in advance of the expiration of its license in 2014.

Le 27 mai 2010, la Broadcasting Sanctions Committee (Commission des Sanctions de l’Autorité britannique de régulation des communications électroniques et de l’audiovisuel (Ofcom) a sanctionné pour un montant de £225.000 Teletext Limited, validant en outre la révocation administrative opérée le 29 janvier 2010 par Ofcom de la délégation de service public concernant la fourniture de services de télétexte, suite à la cessation unilatérale de la diffusion de ceux-ci par Teletext le 15 décembre 2009.  

L’Ofcom (The Office of Communications — le régulateur britannique des télécommunications et de l’audiovisuel), a annulé le 29 janvier 2010 la délégation de service public accordé à Teletext Limited pour la fourniture de services de télétexte, et a rendu le 27 mai 2010 un arrêt de sanction de £225.000 à l’encontre de ce dernier, pour avoir unilatéralement cessé de diffuser les services de télétexte le 15 décembre 2009, alors que sa licence n’expirait qu’en 2014.

Teletext Ltd. hat am 27. Mai 2010 eine Strafe von £225.000 von der Ofcom's Broadcasting Sanction Committee (die Sanktionskommission der britischen Medienaufsichtsbehörde) bekommen. Grund dafür ist, dass Teletext Ltd. am 15. Dezember 2009 einseitig aufgehört hat, die Teletextsdienste, für die sie  von einer Übertragung öffentlicher Diensten bezug, zu leisten. Diese Strafe bestätigt auch die Amtsenthebung, die am 29. Januar 2010 infolge der einseitigen Entscheidung von Teletext Ltd., verkündet wurde.


Die Ofcom (The Office of Communication - die britische Mediensaufsichtsbehörde) hat am 29. Januar 2010 Teletext Ltd. aus seiner Amt enthebt, da die Firma am 15. Dezember 2009 einseitig aufgehört hat, die Teletextdiensten zu liefern, für welche sie tätig war, obwohl seine Lizenz noch bis 2014 gültig war. Infolgedessen hat am 27. Mai 2010 die Ofcom auch eine Geldstrafe von £225.000 gegen Teletext Ltd. verhängt.
