The “Conseil économique, social et environnemental – CESE” (French Economic, Social and Environmental Council) expressed its approval of the “Stratégie nationale de développement durable SNDD” (new French National Strategy for Sustainable Development), on January 27 2010, which has been drawn up by the Government for the period 2009-2013. The implementation of a joint consumer information service on Insurance, Banking, and Insurance within the ‘Autorité de Contrôle prudential – ACP’ (French Prudential Control Authority), raises questions as to the way in which the service will be coordinated with the ACP’s other activities. The signature of the agreement creating the new joint service was the occasion for Christian Noyer, Governor of the Banque de France (Central Bank of France) and President of the ACP, to clarify that this joint service, whose principal goal is consumer protection, complements the ACP’s other missions.
After a video recording of his first conference devoted to the relations between Regulation and Supreme Courts, The Journal of Regulation published a book on the future of the audit, based on another conference. This present document, written in French worked with KPMG, from conference co-hosted with this company and the "Ecole de Droit de la Sorbonne", is devoted to the debates around banking regulation and its impacts. The challenge is to enable the persons concerned, that is to say to all citizens to express their opinion on an issue that concerns them directly, but whose technical dimensions, real or serviced, stand them aloof.

The Italian upper administrative court (“Consiglio di Stato”) ruled that the Autorità per le garanzie nelle comunicazioni (“AgCom” – the Italian Regulatory Authority for electronic communications) is not bound to provide a rigorous justification when issuing decisions not compliant with European Commission’s comments.
This judgment is of general interest since, on the basis of a formalistic reasoning, it does not pay adequate attention to the role played by the European Commission in electronic communications’ regulatory proceedings at national level.
Under the European regulatory framework (and the multilevel governance system established therein), comments from the European Commission are the main pillar of the horizontal coordination system between the European level and the national level, aimed at creating a competitive common market for electronic communications.
Procedure is that by which a body of law finds its unity: the right to an impartial tribunal, as stated in Article 6 of the European Convention on Human Rights, created a new unit in Regulation Law, as it also requires from Regulatory Authorities to "show" their impartiality whenever they act as courts.
Nevertheless, little by little, the national courts and the ECHR itself indicated the contours of this right, which cannot, admittedly, end up nullifying the effectiveness of the mission of Regulators.
It is assumed that whenever a Regulatory Authority intervenes whether in "civil matters", i.e., when it affects the civil rights or the property rights of a person, or in "criminal matters", i.e., when it sanctions a significantly serious behavior, the individuals that are exposed to the power of the Regulator are protected against it by the right to impartiality. Since the regulator has the power to judge, it also has to respond to the condition of impartiality.
As such, not only those within the Regulatory Authority involved should not be in conflict of interest or have already experienced the event (personal, subjective and/or objective impartiality), but the Authority in its organization and processes itself shall give to see its impartiality to the person who is threatened by its power- and, beyond, to the entire society. This objective structural impartiality is called after English law "apparent impartiality."
Following the creation of the Authority of Accounting Standards (ANC – autorité des normes comptables) by the Ordinance of 22 January 2009, the Decree of 15 January 2010 defines its operational structure.
The Direction générale de la concurrence, de la consommation, et de la repression des fraudes (DGCCRF – The French Directorate General for Competition, Consumer Affairs, and Repression of Fraud) organized a Competition Workshop on the theme “Transportation and Competition” that took place at the Ministry of Economics, Finance, and Industry, in Paris, on December 16, 2010. These workshops, which are half-day conferences on a given theme, have been organized by the DGCCRF multiple times a year on various themes since 1994. This event was chaired by Anne Wachsmann, a lawyer at Linklaters, and Christophe Lemaire, a teaching assistant at the Law School of the Sorbonne, and a lawyer at Ashurst.

La Direction générale de la concurrance, de la consommation, et de la repression des fraudes (DGCCRF - Directiva general francesa para la competencia, asuntos del consumidor y la represión del fraude) organizó unTaller de Competencia sobre “Transporte y Competencia” que se llevó a cabo en el Ministerio de Economía, Finanza e Industria en Paris el 16 de diciembre del 2010. Estos talleres, que son de una duración de medio día, han sido organizados por el DGCCRF en múltiples ocasiones a lo largo del año sobre varios temas desde 1994. Este evento fue dirigido por Anne Wachsmann, una abogada de Linklaters, Cristophe Lemaire, un profesor asistente en la Universidad Sorbonne, y un abogado proveniente de Ashurst.
