The Commission did it, considering that, on the relevant market of financial derivatives, the concentration would give the new firm almost monopoly and that the proposed remedies, notably the access for competitors to the clearing house, are Insufficient.

A recommendation concerning professional “good practices” in pharmaceutical treatments issued by the Haute Autorité de la Santé (French Healthcare Regulator) was attacked before the Council of State by an association. It was invalidated by Council of State decision on April 27, 2011 for violation of the principal of impartiality, because members of the regulator’s working group had interests in the pharmaceutical industry.

Una raccomandazione relativa alle “buone prassi” nei trattamenti farmaceutici resa dalla Haute Autorité de la Santé (l’autorità francese di regolazione in materia di salute) era stata contestata da un’associazione dinanzi al Consiglio di Stato. Il 27 aprile 2011, il Consiglio di Stato ha annullato tale raccomandazione in quanto resa in violazione del principio d’imparzialità, diversi membri del gruppo di lavoro nominati dall’autorità di regolazione avevano interessi personali nell’industria farmaceutica.

I. Isolated Articles

The Law of Compliance is a branch of law so recent that some still doubt its very existence.

This paper does not take up this question again, nor that so often evoked of the "definition" of the Compliance and the Law that goes, nor the issue of the translation which is appropriate for it.

The purpose of the reflection is rather to observe the movement that started from the requirements of specific sectoral Law, such as Financial Law and Banking Law, which undeniably correspond to "sectors", the Law of Compliance being the extension of the Law of Regulation, an extension that metamorphoses it, extending beyond the regulated sectors.

In the United States, if the State courts took different positions on whether the game of poker is a game of chance or a game of strategy, this is the first time that a federal jurisdiction decides the issue by this judgment of August 21, 2012 ruled by Judge Jack Weinstein. The question is crucial for the Regulation of online gambling because gambling is regulated or even prohibited by State, but not strategy games. Qualification depends on the definition that is given in the game according to the judge, who relied on recent scientific studies, the gain in poker does not depend poker mostly luck but skill. Therefore, it escapes the regulations that surround gambling.

The European Commission published on April 11, 2012, a follow-up and summary report of on the application of the third directive "Anti-Money Laundering " which gives a community value to on international standards adopted by the Financial Action Task Force (FATF). This is to protect the financial system against the money laundering. The report assesses the effectiveness of the application of the directive and points out the need for change. The Commission requests that the standards for the detection of risk of money laundering are better targeted and oriented in the gambling sector. It also suggests that tax offences be regarded as offences of money laundering. As individuals, the report requires to banks and other professionals to increase their due diligences requirements. It also covers the "persons politically exposed", that is - to say those may be corrupt. The report finally requests a special assessment on the application of the Directive to independent legal professionals, including lawyers, subject to the legal obligation to report .

Breaking news

On 6 June 2012, the European Commission has extended the authorization given to France, Belgium and Luxembourg to bring their State guaranty to Dexia Bank SA and DLC. Further, the Commission agreed to raise the ceiling of the guaranty, joint but non several, of EUR 15 billion which brings the ceiling allowed to EUR 55 billion. But the permission is only until September 30. This might coincide with the time where the Commission will take a position on the plan of "orderly resolution" of this systemic bank. It justifies its flexibility itself in its exemption from the prohibition of State aids, by the fact that it is a systemic bank and that a resolution plan will be submitted soon, but it raises in advance competition problems.This justifies all the more draft texts on the mechanisms which must be specific to the systemic failing financial institutions.

In the conference cycle organized by the Journal of Regulation & Compliance (JoRC) on the topic of the Europe of Compliance, at the conference of May 30, 2018, Xavier Musca, Deputy Chief Executive Officer of the Crédit Agricole Group expressed how including a European company with a global dimension, whose activity is more specifically banking, integrates the new phenomenon of Compliance!footnote-98.

This reflexion was in continuation of the more general presentation that Jean-Jacques Daigre had just made of the opportunity that Compliance represents, before Pierre Vimont took advantage of the remarks'Xavier Musca by questioning the aptitude of the European institutions to make such a project a reality.
