The United States Court of Appeals for the District of Columbia Circuit strikes down a decision that the Federal Communications Commission (FCC), the American telecommunications regulation agency, had taken against an Internet service provider, on the grounds that the FCC is incompetent to impose the theory of network neutrality on Internet service providers.
In Belgium, the Flemish Region had adopted the Decree of 23 December 2010 to exemp those providing electricity with a renewable source to pay the rate of injection into the electricity transmission network. The Region stated that it was not an act tariff, thus falling under its jurisdiction. The decree, attacked by the energy regulator before the Belgium Constitutional Court, was canceled by the latter in a ruling dated July 12, 2012, because it is an act of pricing, under the only federal competence.

Ce décret, attaché par le Régulateur de l'Energie devant la Cour Constitutionnelle de Belgique, a été annulé par celle-ci dans une décision en date du 12 juillet 2012, parce qu'il s'agit bien d'un acte touchant à la tarification, pour laquelle seul des organes fédéraux sont compétents.
The Tribunal des Conflits ruled in a May 2, 2011 decision that administrative courts have jurisdiction over examining the Autorité des marchés financiers (AMF—French Financial Markets Authority)’s liability when the facts involved are unrelated to an individual decision against a corporate plaintiff, but rather pertain to the conditions under which applications for the approval of documents relating to public issuance of shares are examined: the AMF is a legal person incorporated according to public law, and this is not a case in where jurisdiction had specifically been transferred to civil courts of law.

What is called the "Libor" is a contraction of "London InterBank Exchange Rate". Each morning, the banks reported Libor rates and all of the exchanges are backed with these statements. It is therefore the confidence that we make to them that holds the system. In a declarative system, it was easy for the Barclays Bank to report an inaccurate Libor, upward or downward, according to trade that it wanted to do. This is legally of course a price manipulation, which was sanctioned by the "Financial Securities Authority - FSA" on June 27, 2012, inflicting Bank fined nearly £ 60 million. But it is especially throughout the system of credibility of this Bank, and banks, which is undermined, since everything is based on the statements. We understand that therefore all managers are laid off, etc. Will that be enough to keep a system purely declarative?
In India, a special Department of the Ministry of Health control the drug sector and issue market authorisations for medicines, the Central Drugs Standard Control Organization (CDSCO). A report of the Indian Parliament has concluded that responsibilities within the Organisation had not respected the rules of regulation and not required that drugs are subject to mandatory tests before issuing to them an authorisation on the market, and even if some of them are banned in other countries. The conclusion of the report is that such a breach cannot be only explained by collusion between regulator and pharmaceutical industry. The Government will initiate an investigation.
Competition is the principle element of markets, in the princely sense of the term.The relationships that regulation maintains with competition are ambiguous. It is important to eliminate this ambiguity in order to reveal the ab initio opposition between regulation and competition, to shed light upon the dialectics between both of them. Indeed, regulation may aim at building competition, and is thereby presented as a tool that will cease being used when the competitive market functions effectively.

La concorrenza è il principio fondamentale dei mercati, nel senso stretto del termine. Le relazioni tra regolazione e concorrenza sono ambigue. Per rivelare il contrasto tra regolazione e concorrenza è importante cancellare questa ambiguità e chiarire la dinamica di questi due concetti. In effetti, la regolazione punta a sviluppare la concorrenza ed è spesso considerata uno strumento che non avrà più ragion d’essere una volta che il mercato funzionerà in libera concorrenza.

Es importante eliminar esta ambigüedad para poder revelar la posición ab initio entre la regulación y la competencia, para poder traer a luz las dialécticas entre las dos. Así tanto, la regulación puede intentar construir la competencia, y es, por consiguiente, un instrumento que cesará de ser utilizado cuando el mercado competitivo funcione de manera eficaz.
The European Commission published its Green Paper on October 13, entitled Audit Policy: Lessons from the Crisis. Without intending to perform a substantial or methodological analysis of this Paper, which is seminal because the avenues it opens up will define the choices that will be made about future mandatory legislation.
