On December 20, 2011, the European Commission adopted a decision based on the Almark ruling that expounds upon the four conditions necessary so that compensation paid by a State to any state-owned or private company entrusted with the operation of a public service not require prior notification of the European Commission, despite the general prohibition on State Aids. Each state has a wide margin of discretion in the definition of services that could be classified as being services of general economic interest. A communication and de minimis regulation will complete this decision.

Par une décision du 20 décembre 2011, la Commission Européenne, s’appuyant sur l’arrêt Almark , développe les 4 conditions pour que les compensations versées par un Etat à une entreprise, qu’elle soit publique ou privée, pour qu’elle assure un service public, ne donne pourtant pas lieu à notification à la Commission européenne, malgré la prohibition des aides d’Etat. Les Etats sont légitimes à définir les activités qui relèvent de l’intérêt économique général. Une communication et un règlement de minimis  complèteront cette décision.

El 20 de diciembre del 2010, la Comisión Europea adoptó una decisión basada en la decisión Almark que trata de las cuatro condiciones necesarias para que una compensación pagada por el Estado a cualquier empresa pública o privada no requiera de una notificación previa a la Comisión Europea, a pesar de la prohibición general sobre Asistencias Estatales. Cada estado tiene un gran margen de discreción en la definición de servicios que podrían ser clasificados como servicios de interés económico general. Una comunicación y regulación de minimis completará la decisión.

Il 20 dicembre 2011, la Commissione europea, sulla base della decisione Almark, ha identificato le quattro condizioni in presenza delle quali gli aiuti dati dallo Stato ad un’azienda, pubblica o privata, per far assicurare un servizio pubblico, non sarà necessario fare una notifica alla Commissione, nonostante il divieto di procedere con degli aiuti di Stato. Ogni Stato avrà un ampio margine di manovra nella definizione dei servizi che possono essere qualificati come servizi di interesse generale. Una comunicazione ed un regolamento de minimis completeranno questa decisione.

On January 30, 2010, the "Commission des sanctions" (Sanction Commission) of the French Financial Markets Regulator ("Autorité des Marchés Financiers" -AMF) has sanctioned, by administrative fines, two fund managers to have used inside information, what constitutes a breach of insider trading prohibited by the "Code monétaire et financier" (French Monetary and Financial Code). On Field probation, the "Conseil d’Etat" (French State Council) admits that without direct evidence, the regulator may settle for a body of evidence from which it follows that the action on the market of those prosecuted may restrict explained by the detention of the information in question. But concretely, the Council of State considers that the only information provided to managers do not back the transaction (an IPO) and do not constitute an implicit revelation. The sanction decided by the regulator is broken.

Chaque année, en France, la Haute Autorité de Santé (French National Autority for Health) établi un "projet d'établissement". Le 18 septembre 2013, son président a indiqué ce qui sera la ligne de force du projet pour 2013. En effet, le "seul objectif sera de faire de la qualité un outil de la régulation". On comprend ainsi que tous les outils techniques à la disposition de l'autorité, évaluation, certifications, accréditions, sont utilisés de cette façon. On peut se réjouir de l'unicité de l'outil, alors que la régulation souffre souvent de poursuivre plusieurs buts. Mais l'expression même selon laquelle la qualité peut être un "outil de régulation" est difficile à comprendre, car la qualité paraît davantage pouvoir être un critère qu'un outil.

The Hungarian Parliament voted a law on December 21st, 2010, which came into force on January 1st, 2011, according to which indirect government control over the media is made very tight. This intervenes at the exact same time that Hungary overtakes the rotating Presidency of the European Council. Hungary has now two weeks to put the law in conformity with European standards, otherwise, the European Commission will start legal proceedings against the country.

Le Parlement hongrois a voté une loi le 21 décembre 2010, entrée en vigueur le 1er janvier 2011, qui rend le contrôle indirect des media par le gouvernement très strict. Cela intervient exactement au moment où la Hongrie prend la Présidence tournante de l’Union Européenne. La Hongrie dispose dorénavant de deux semaines pour mettre la loi en conformité avec les standards européens, sans quoi la Commission Européenne commencera une procédure contre le pays.

Das ungarische Parlament hat am 21. Dezember 2010 ein Gesetz abgestimmt, das am 1. Januar 2011 in Kraft getreten ist, und das die indirekte Medienstaatsaufsicht strenger macht. Dies geschieht gerade als Ungarn die wechselnde EU-Präsidenschaft übernimmt. Ungarn verfügt uber zwei Wochen, um das Gesetz vertragsgemäß zu machen. Ansonsten wird die Europäische Kommission ein Verfahren gegen Ungarn einleiten.

Informe temático (medios de comunicación): Hungría vota una nueva ley sobre los medios de comunicación, lo cual podría infringir sobre la carta de derechos fundamentales de la Unión Europea.

El Parlamento húngaro votó una nueva ley el 21 de diciembre del 2010, lo cual entró en vigencia el 1ero de enero del 2011, en donde se estipula que los medios indirectos de comunicación del  gobierno serán sujetos a un control más estricto. Este suceso ocurre en el mismo instante que Hungría toma la Presidencia del Consejo Europeo.  Hungría ahora tiene dos semanas para armonizar esta ley con los estándares europeos, y si falla en este intento, la Comisión Europea comenzará un procedimiento legal contra este país.

Il 1° dicembre 2010, il parlamento ungherese ha adottato una nuova legge, entrata in vigore il 1° gennaio 2011, la quale prevede un controllo stringente ed indiretto del governo sui mass-media, al contempo l’Ungheria lascia la Presidenza del Consiglio europeo. Restano due settimane all’Ungheria per conformarsi agli obblighi dettati dagli standard europei, altrimenti la Commissione Europea comincerà una procedura a livello europeo contro lo Stato.

O Parlamento húngaro adotou uma lei no dia 21 de dezembro de 2010, que entrou em vigor em 1° de Janeiro de 2011, na qual se prevê que o controle indireto dos meios de comunicação pelo governo passará a ser mais rigoroso. Este fenômeno ocorre no mesmo instante em que a Hungria assume a Presidência do Conselho europeu. Este país agora tem duas semanas para adequar esta lei aos parâmetros europeus e, se falhar nesta tarefa, a Comissão Europeia poderá iniciar uma ação judicial contra este país.

Regulation of the digital world, we agree on its necessity, we talk about it a lot but it is difficult to do it.

The stakes are multiple: management of innovation, protection of people, treatment of different sorts of powers, future of the human being, the Politics and the Judge being like a bullet that ricochets between these 4 subjects.

It then rediscovers that the first "regulators" are the Governments and that the first modality of the Regulation Law  is the taxation.

Notably in the digital field and even more so in the face of GAFA.


Indeed, the 4 American companies, Google, Apple, Facebook and Amazon, admit the need for rules but propose self-regulation or co-regulation. These would include not only their own behavior, but also those of others, including the fight against terrorism. Maybe, when one is stronger than the States, he should substitute himself for their core business....

Undoubtedly being dispossessed of the regalian, Europe today demands "accounts" to the GAFA in the literal sense of the term. Indeed, the French and German governments will table in September a tax proposal specific to the GAFA, the fruit of which will come back to the countries where they earn their income.

Concerned companies replied that in the tax system everyone has the right to be skilled and to organize at the best, so long as one does not fall into the abuse. In accordance with this legal conception, the French administrative high Court (Conseil d’État) has just recalled it in an important decision to their benefit.

In August 2017, the French Minister of Economy and Finance, Bruno Lemaire, justified  the reiteration of his will to tax them, raising this issue at European level in the name of "distributive justice", the Law being defined as what gives everyone his share. This is a strong but dangerous argument, for while it is true that in the very function of taxation, correlated with public finances, the redistributive function is essential, tax optimization becomes staggering.

In a more convincing and regulatory way, this measure of equity is presented as correlated to the construction of the European digital market. It is an economic conception. To the extent that European taxation is still embryonic, its link with such a construction would make it possible to see in vivo the strength of the tax tool in Regulation Law, more than ever distant from Competition Law.

It is in this context, and because the European Digital Market must be built at forceps, since the GAFA will benefit from it, but also must participate in its construction, that such an investment sharing is justified.

The Autorité de la Concurrence (French Competition Authority) issued a recommendation (n° 11-A-05) on March 8, 2011 in which it recommends that the Autorité de régulation des communications électroniques et des postes (ARCEP — French Telecommunications and Postal Regulatory Authority) proceed with studies envisaging the possible breakup of France Telecom into two separate functional entities, one managing monopoly activities (the network), and the other managing competitive activities (services).

Informe temático (Telecomunicaciones): La Autoridad francesa de la competencia recomienda que el Regulador francés de telecomunicaciones considere una separación funcional de las actividades de France Telecom.

La Autorité de la Concurrence (la Autoridad francesa de la competencia) publicó una recomendación (n°11-A-05) el 8 de marzo del 2011 en la que recomienda que la Autorité de régulation des communications électroniques et des postes (ARCEP – la Autoridad regulatoria francesa de telecomunicaciones y servicios postales) proceda con sus estudios concibiendo la posible división del France Telecom en dos entidades funcionales separadas, uno que manejaría las actividades monopolísticos (la red), y el otro manejando las actividades competitivas (los servicios).

The European Commission conducted a competition inquiry on the competitiveness of European energy markets, because it believed that these markets functioned poorly, especially because they are insufficiently open to competition and their prices are too high. Proceedings were begun in December 2009 against E.ON, and were closed by this corporation’s May 4, 2010 legally-binding commitments to the European Commission to improve its competitors’ access to its natural gas transportation network. Access to transportation networks, which are essential facilities, is the heart of any regulatory system, and if access was not organized beforehand (ex ante), it can be arranged afterwards (ex post), as is the case in this affair, via an alliance between Competition Law and Contract Law, wherein the commitments take on the form of a sort of co-regulation (cf. infra brief summary)

Par une décision du 4 mai 2010, la Commission Européenne a accepté le les engagements proposés par la société énergétique allemande E.ON d’ouvrir davantage à ses concurrents l’accès à son réseau de transport de gaz.

La commission européenne a mené en 2007 une enquête sectorielle sur le fonctionnement concurrentiel des marchés énergétiques européens en estimant que ceux-ci fonctionnent mal, notamment puisqu’ils sont peu ouverts et leurs prix trop élevés. Une procédure ouverte en décembre 2009 contre E.ON est ici close par l’engagement de celle-ci envers la commission européenne d’ouvrir à ses concurrents son réseau de transport de gaz. L’accès au réseau de transport, facilité essentielle, est le cœur du système de régulation et s’il ne se fait pas {ex ante} il peut se faire alors {ex post}, comme on le voit dans cette affaire, par une alliance entre le droit de la concurrence et le droit du contrat, l’engagement devenant une sorte de corégulation (voir infra dans le bref commentaire).

Die Europäische Kommission hat am 4. Mai 2010 ein Beschluss veröffentlicht, in dem sie die Zusage des deutschen Energiekonzerns E.ON, der Konkurrenz effektiven Zugang zu seinen Gasleitungen zu öffnen, für verbindlich erklärt.

 

Die Europäische Kommission hat eine kartellrechtliche Untersuchung im Energiesektor durchgeführt, da sie die europäischen Energiemärkte für ineffizient hielt, vor allem aufgrund mangelnden Wettbewerbs und zu hohen Preisen.  Mit dem Beschluss vom 4. Mai 2010 werden die von E.ON angebotenen Verpflichtungen, den Zugang zu den Gasnetzwerken für potentielle Konkurrenten zu öffnen, für rechtlich bindend erklärt. Zugang zu Transportnetzen, die als wesentliche Einrichtungen ({Essential Facilities}) zählen, ist zentral für jedes Regulatierungssystem. Wenn dieser Zugang nicht im Voraus ({ex ante}) organisiert ist, kann er trotzdem im Nachhinein ({ex post}) etabliert werden, wie es hier den Fall ist, durch ein Bündnis zwischen Wettbewerbsrecht und Vertragsrecht, indem das Unternehmen durch seine Verpflichtungen quasi mitregulierend wirkt (siehe unten {Brief Summary})

En una decisión del 4 de mayo 2010, la Comisión Europea acepta los compromisos de la corporación alemana de energía, E.ON, para mejorar el acceso de competidores a la red de transporte del gas natural.

 

 

La Comisión Europea llevó a cabo una encuesta sectorial sobre la concurrencia en los mercados europeos de energía, ya que sea cree que estos mercados no funcionan de manera eficaz, especialmente porque no son los suficientemente abiertos a la competencia y sus precios son demasiado altos. Los trámites comenzaron en diciembre del 2009 contra la E.ON y fueron cerrados por ésta ante sus  compromisos vinculantes ante la Unión Europea del 4 de mayo 2010 de mejorar el acceso de competidores a la red de transporte de gas natural. El acceso a las redes de transporte, que son facilidades esenciales, se encuentra al centro de cualquier sistema regulatorio, y si el acceso no fue organizado anteriormente (ex ante), puede ser organizado posteriormente (ex post), como en este caso a través de un alianza entre la Ley de la Concurrencia y la Ley de Contrato, donde los compromisos actúan de manera ‘co-regulatoria’ (VER.
