L'auteur rappelle ce cas dans lesquelles les banques membres du GIE ont été condamnées par la Commission européenne, en ce que les nouvelles règles adoptées au sein de ce GIE de gestion du mécanisme des cartes bancaires, qualifiées de "régulation" avaient un "objet anticoncurrentiel", ce qui suffisait à justifier la condamnation des opérateurs (décision de la Commission du 17 octobre 2007). Le Tribunal de Première Instance a confirmé cette analyse par un arrêt du 29 novembre 2012, estimant que la condamnation était fondée, puisque par sa nature un tel accord était "susceptible de produire des effets négatifs sur la concurrence".

Cela est invalidé par la Cour de justice, qui casse l'arrêt et renvoie le cas devant le Tribunal de première instance car le fait que l'accord soit "susceptible d'affecter la concurrence" ne le rend pas "anticoncurrentiel par objet".

On November 28, 2011, the French Council of State issued a summary judgment suspending the Government price freeze on household natural gas prices because the ‘price scissors’ effect it had was harming competition, and because no superior legal norm justified the freeze.

Le 28 Novembre 2011, le Conseil d’Etat a rendu une Ordonnance de référé, suspendant le gel des prix du gouvernement concernant les prix domestiques du gaz naturel, car l’effet de «ciseaux des prix"  avait pour effet de nuire à la concurrence, et parce qu’il n’existe pas de norme juridique supérieure justifiait ce gel des tarifs par un décret.

El 28 de noviembre del 2011, el Conseil d’Etat (Consejo de Estado de Francia) decidió que la prohibición de los OGM establecido por varias decretos ministeriales en diciembre 2007 y febrero 2008 no son válidos. La razón principal detrás de esta decisión es la falta de prueba suficiente dada por el gobierno francés que los OGM representan una gran amenaza a la salud pública y el ambiente. No obstante, los Ministros de Agricultura y Ambiente declararon el 13 de enero 2012 que esta misma prohibición será adoptada.

Published by Oxford University Press (OUF), the collective book, Public Accountability, edited by Mark Bovens, Robert Goodin and Thomas Schillemann, consists of 43 contributions.

Few strictly focus on issues of regulatory matters. One can still quote the article by Colin Scott on Independent Regulators or those of Christie Hayne, Steven E. Salterio and Paul L. Posner and Shahan Asif on auditing (Accounting and Auditing; Audit Institutions).

The subject of most of the contributions is rather the necessary renewal of the management of the State, public governance incorporating this new way of "accountability," which explains the book title : itself: Public Accountability. But as we know that the line between public and private is more porous than ever, we can appreciate that the bookk extends its thoughts to the governance of private organizations or non-profit private sector by some contributions.

Indeed, the fact that Accountability is what is common to the Regulation and Governance. This is the first sentence of the book : "Accountability is the buzzword of modern governance".

Probably because of accountability has become a central concept, as shown in the introductory contribution, these are the articles that confront the most general elements such as "time" (Accountability and Time), "crisis" (Accountability for Crise) or "trust" (Accountability and trust), which are the most instructive for the future.

Thus, despite its collective character, the book is very consistent and often takes a critical tone about this invasion of public space by the will of accoutability, the authors emphasizing the "deficits", the failures and especially thet prohibitively expensive of this mechanism.

It would come to regret the simple mechanism of hierarchical rule to which a nostalgic contribution is devoted, which describes how operated the State before we apply to it the State the agency theory.

So it is a practical book, complete, critical and prospective, of great interest.

The Nigerien Minister for Communication, New Technologies, Information, and Culture, Mrs. Takoubakoye Amina Boureima, announced at the 3rd African Telecommunications Union plenipotentiary conference in Brazzaville, on September 26, 2010, that her country would implement a system for the regulation of international telecommunications similar to the Congolese system.
