ENGLISH

The ambition of this thesis is to identify the notion of regulation, but strictly limits itself to French administrative law. To do this, the author skilfully identifies the 'act of regulation', created by Independent Administrative Authorities to effectively carry out their regulatory tasks. This is both a functional definition, using the notion of 'mission', and a methodological one, with its permanent reference to Independent Administrative Authorities.

L’ambition de cette thèse est d’identifier la notion de régulation, mais elle se limite strictement au droit administratif français. A cette fin, l’auteur identifie habilement “l’acte de régulation”, crée par les Autorités Administratives Indépendantes pour mener à bien leur mission de régulation. C’est une définition à la fois fonctionnelle, qui utilise la notion de “mission”, et méthodologique, se référant constamment aux AAI.

Para realizar esto, el autor identifica el ‘acto de la regulación,’ creado por la Independent Administrative Athorities (las Autoridades administrativas independientes) para efectivamente llevar a cabo sus tareas regulatorias. Esto es tanto una definición funcional, usando la noción de ‘misión,’ como metodológica, con su referencia permanente a las Autoridades administrativas independientes.

Esta é uma definição tanto funcional, valendo-se da noção de “missão”, quanto metodológica, fazendo referência permanente às Autoridades Administrativas Independentes.

L’ambizione di questa tesi è identificare la nozione di regolazione, esclusivamente nell’ambito del diritto amministrativo francese. Per riuscire nell’impresa, l’autore identifica lo “atto di regolazione”, creato dalle Autorità Amministrative Indipendenti al fine di compiere la loro missione in materia di regolazione. Questa definizione è pertanto teleologica, poiché si concentra sulla nozione di ‘missione’, ed al contempo metodologica, facendo riferimento costante alle Autorità Amministrative Indipendenti.
