Thematic Report (Energy): The Swiss Federal Administrative Tribunal ruled on July 8th, 2010, that ElCom, the Swiss energy regulator, had overridden its powers in its decision of March 6th 2009.
In a decision of July 8th 2010, the Bundesverwaltungsgericht (the Swiss Federal Administrative Tribunal) partially amended a decision of the Eidgenössiche Elektrizitätskommission (ElCom, the Swiss Federal Electricity Commission), stating that it is unconstitutional and illegal for power-plant operators to bear the price of “system-services”.

Dans un arrêt du 8 juillet 2010, le Bundesverwaltungsgericht (le Tribunal Fédéral Administratif suisse) a partiellement annulé une décision de l'Eidgenössiche Elektrizitätskommission (ElCom, la Commission fédérale suisse de l'électricité), déclarant qu'il est anticonstitutionnel et illégal que les opérateurs des centrales électriques supportent le coût des "services systémiques"

Thematischer Bericht (Energie): das schweizerische Bundesverwaltungsgericht hat am 8. Juli 2010 die Verfügung der ElCom, die  Eidgenössische Elektrizitätskommission, die Schweizer Regulierungsbehörde für Elektrizität, vom 6. März 2009 für ungültig erklärt.



In einer Entscheidung vom 8. Juli 2010 hat das Schweizer Bundesverwaltungsgericht eine ElCom-Verfügung vom 6. März 2010 zum Teil für ungültig erklärt, da die in der Verordnung vorgesehene Anlastung der Systemdienstleistungskosten an die Kraftwerke gesetzeswidrig ist.

   Informe Temático (Energía):  El Swiss Federal Administrative Tribunal (El Tribunal administrativo federal de Suiza) dictó el 8 de julio 2010 que ElCom, el Regulador suizo de energía, había sobrepasado sus poderes en su decisión del 6 de marzo 2009.

En una decisión del 8 de julio 2010, el Bundesverwaltungsgericht (El Tribunal administrativo federal de Suiza) anuló parcialmente la decisión de   Eidgenössiche Elektrizitätskommission (ElCom, la Comisión suiza de electricidad federal) constatando que es inconstitucional e ilegal que las operadoras de centrales eléctricas soporten el precio de “servicios sistemáticos.”

Access is a key concept in regulation since only a competitive market allows access for all to becom offerers and applicants. This is why regulations and regulators intervene ex ante to force access to natural monopolies, such as transport networks, for the benefit of other operators. Thus, Regulation compensates for market failures by imposing access. In addition to these access imposed for technical reasons, the Politics can still intervene to force for all access to common goods, such as culture, health, education, referring to the Social Contract. The foundation, political, is different.

United States Patent and Trademark Office, et al. case, before the Court of Appeal for the Federal Circuit, the US Department of Justice reversed a longstanding policy by declaring human genes ineligible for patents, because they are part of nature. This new position could have an enormous impact on the medical and biotech industries.

On May 4, 2012, Ofcom announced the award of four new community radio licences for services in the south west of England. Community raido service are provided on a not-profit basis focusing on the delivery of specific social benefits tot a particular geographical community or a community of interest. The new awards mean that 251 community radio licences have been awordes for four services in Cornwall and Devon. Some radio services are about health thematics or weillbeing and lifestyle topics, others provide community radio services, for example to villages.

The Italian upper administrative court (“Consiglio di Stato”) ruled that the Autorità per le garanzie nelle comunicazioni (“AgCom” – the Italian Regulatory Authority for electronic communications) is not bound to provide a rigorous justification when issuing decisions not compliant with European Commission’s comments. This judgment is of general interest since, on the basis of a formalistic reasoning, it does not pay adequate attention to the role played by the European Commission in electronic communications’ regulatory proceedings at national level. Under the European regulatory framework (and the multilevel governance system established therein), comments from the European Commission are the main pillar of the horizontal coordination system between the European level and the national level, aimed at creating a competitive common market for electronic communications.

In February 2011, the "Autorité de régulation des jeux en ligne" (ARJEL – French Online Gambling Regulatory Authority) has asked Pokerstars to shut down its Home Games, which the online gambling site has agreed to do. After that,the regulator has written to all operators to remind them that any modification of their platforms must be submitted to it for prior approval. This appoval has been given on may, 12, 2011. The Home Game is reserved to players, which account member has been validated by Pokerstar.

Durante il mese di febbraio 2011, la "Autorité de régulation des jeux en ligne" (ARJEL – l’Autorità francese di regolazione delle scommesse online) ha richiesto alla società Pokerstars di interrompere il suo Home Games e la società si è conformata a tale richiesta. Successivamente, l’Autorità di regolazione ha scritto a tutti gli operatori ricordando che ogni modificazione della loro piattaforma dovrà essere sottoposta alla sua autorizzazione. Il 12 maggio 2011, è stata concessa questa autorizzazione. The Home Game è dunque riservato a degli utenti, il cui account è stato controllato e confermato da Pokerstars.
