This report ambits to improve the regulation of industrial networks in France and in Europe. Therefore, the Fondation nationale Entreprise et Performance (FNEP) concentrates its study on industrial networks, a category in which it includes telecommunications, energy, rail transportation, and postal services, in France and in Europe. The report proposes new rules or adaptations to old ones in order to increase regulators’ independence, efficacy, and oversight. It then suggests rules be modified to allow for the implementation of regulation at the European level, whenever the relevant market is European in scale.

Questa relazione punta a migliorare la regolazione delle reti industriali in Francia e in Europa. Tuttavia la “Fondation Nationale Entreprise et Performance” (FNEP) focalizza la sua attenzione sulle reti industriali, una categoria che include le telecomunicazioni, l’energia, il trasporto ferroviario ed i servizi postali, in Francia ed in Europa. La relazione propone delle nuove regole o una modifica delle regole esistenti per aumentare l’indipendenza, l’efficacia e la vigilanza delle autorità di regolazione. Inoltre, propone di modificare alcune norme per permettere l’applicazione della regolazione al livello europeo, ogni volta che il mercato rilevante è quello europeo.
Olivier Fréget is a partner at Allen & Overy Paris heading the Paris EU & Competition team. He hold a post graduate degree in Private International Law and in International Business Transactions (University of Paris I) and a degree in Economics and International Relations (ILERI).
Olivier has specialised in EU and competition law since the very beginning of his career in 1990
Professor Benzoni was Full Professor at Telecom Paris-Tech (1985-1995) before becoming a Full Professor of Economics at Université Paris 2 in 1996. He is a Founding Partner of TERA Consultants (1995), a member of ERMES (Research Team on Markets, Employment and Simulation: research center associated with CNRS-National Center of Scientific Research), Member of the Administration Board: Avignon’s World Forum-Culture-Economics-Media, Member of the Scientific Committee: “Competition Workshop” of he French Finance and Economy Ministry, Scientific Director of Quantifica-OMSYC (1988-2009), Member of the Editorial Board of Communication & Strategies.
He won The Industrial Economics Prize (ADEFI) for his work on Exhaustible resources and their regulation, the Harvard-Expansion Prize for the o-authored book: Energy Economics, the IREST prize (Institute for Research in Economics and Social sciences in Telecommunications) for contribution to Economics of telecommunications regulation.
Nomineted as a World’s Leading Competition Economist by The Global Competition Review.
After a video recording of his first conference devoted to the relations between Regulation and Supreme Courts, The Journal of Regulation published a book on the future of the audit, based on another conference. This present document, written in French worked with KPMG, from conference co-hosted with this company and the "Ecole de Droit de la Sorbonne", is devoted to the debates around banking regulation and its impacts. The challenge is to enable the persons concerned, that is to say to all citizens to express their opinion on an issue that concerns them directly, but whose technical dimensions, real or serviced, stand them aloof.

La présente publication, écrite en française, élaborée avec KPMG, à partir de la conférence organise avec celle-ci et l’Ecole de Droit de la Sorbonne, est consacrée aux Débats autour de la régulation bancaire et ses impacts. In an amicus curiae brief of October 29, 2010, in the Association for Molecular Pathology, et al. v. United States Patent and Trademark Office, et al. case, before the Court of Appeal for the Federal Circuit, the US Department of Justice reversed a longstanding policy by declaring isolated human genes ineligible for patents, because they are part of nature. This new position could have an enormous impact on the medical and biotech industries.

The main theme of the eighth issue of The Journal of Regulation is that
of Neutrality in systems of economic regulation in accordance with the
conference that the Journal organized around this issue. This question
is essential for a number of reasons: on one hand, companies sometimes
demand that regulation be ‘neutral’ in the impact it has on their
economic activities. On the other hand, States have other reasons for
believing that regulation palliates market failure by using price-fixing
to restore neutrality in certain sectors of the economy that are
incapable of producing a fair market price. Still others believe that
Regulation is not neutral because it intervenes against the neutrality
of the market by imposing access to common goods, social policy
concerns, etc.

Le principal thème du 8° numéro du Journal of Regulation est la question de la neutralité dans les systèmes de régulation économique, telle qu’elle avait été examinée dans le colloque annuel du Journal. Cette question est essentielle pour un certains nombres de raisons. D’une part, les entreprises exigent parfois que les régulation soient "neutres" dans les activités économiques des entreprises. D’autre part, les Etats peuvent avoir d’autres raisons d’adopter des régulations que de palier des défaillances de marchés, lesquelles sont incapables de produire des prix. Les Etats restaurent alors par leurs interventions une neutralité que les marchés ne peuvent pas techniquement engendrer. D’autres croient encore que la Régulation n’est pas neutre parce qu’elle intervient précisément contre la neutralité du marché, en imposant l’accès pour tous à des biens communs, décisions politiques adoptées pour des considérations de politique sociale.

Il tema principale di questo ottavo numero de The Journal of Regulation è la Neutralità nei sistemi di regolazione economica in linea con la conferenza organizzata dalla rivista relativamente a tale tema. Tale tema riveste un’importanza fondamentale per diverse ragioni: da un lato, le società talvolta richiesto che tale regolazione sia neutrale rispetto all’impatto provocato sulle loro attività economiche. Inoltre, gli Stati hanno diverse ragioni per considerare che la regolazione riduca il rischio di disfunzioni del mercato usando il potere di fissazione del prezzo garantendo così la neutralità che certi settori sono incapaci di raggiungere in quanto incapaci di stabilire un prezzo equo di mercato. Infine, altri ritengono che la Regolazione non sia neutrale in quanto interviene sulla neutralità del mercato ed impone l’accesso ai beni comuni, obiettivi di politica sociale, ecc.

Esta cuestión es esencial por varias razones. De una parte, las empresas a veces exigen que las regulaciones sean “neutras” en las actividades económicas de las empresas. Por otra parte, los Estados pueden tener otras razones para adoptar regulaciones , a parte de lidiar con los fallos de los mercados, los cuales son incapaces de producir precios. Los Estados restauran, a través de sus intervenciones, una neutralidad que los mercados no pueden engendrar. ► Presentation of the theme: "The "Obligation" is at the heart of many disciplines. Compliance techniques very often take the form of obligations. But to mention only the first questions that come to mind and in cases, especially those that are referred to the courts, it is paradoxically not so much Contract Law and Tort Law that have been used, since Compliance Law is on the one hand often assimilated to the mass of applicable regulations and its unilaterality characteristic of Regulatory Law, the branch of Law that Compliance Law extends, and on the other hand it is often associated with ethics, morality, a shared culture, everything that seems to distance it from Obligation.
The notions of "duty" and "commitment" are increasingly taking their place in Compliance Law, although their scope is still uncertain. This is why, beyond the multiplicity of "compliance obligations", one may ask whether there is an "obligation to comply", what its definition would be and its relationship with everything that, in Compliance Law, is not one obligation.
It is the topic of this conference and the articles that will follow to identify what will be this hypothesis, which is becoming more and more frequent and could become the standard.

Method chosen to deal with the topic: For contributing to what will later become the book on the Compliance Obligation, constituting its first chapter aimed at identifying what could be a definition of Compliance Obligation, the method is not to start from the legal instruments of compliance but rather for each of the contributors to draw on their discipline, which they has mastered technically, in order to project it and formulate what, on the basis of this previous mastery and according to his or her own conception, is or should be, or should not be, the Compliance Obligation.
Each speaker gives a half-hour presentation on his topic, which is followed by a 15-minute debate.
