Breaking news

In the United Kingdom, the Medicine and Healthcare Products Regulatory Agency, by noting the wrongdoing of the scandal of the Breast implants PIP and the clumsy way in which this type of scandal, alarming the population, had been resolved by health authorities, has commissioned a study in January 2012 to analyse this crisis and learn from it behavior lessons for similar crises. On May 14, 2012, the report was published. This report advised the regulator, when it is faced with this type of crisis, to expand its sources of medical information before making provisions, that it didn't do sufficiently. The regulator must also communicate as much as possible with the victims on the one hand (first circle) and the public (second circle) to give information, reassure and encourage good medical behavior.

The role of fibre is very important towards connecting to ultra-fast broadband, one of the key action areas of the Digital Agenda. But, Europe is late in its fibre deployment, especially when compared to other advanced economies such as the United States or Japan. At the same time, however, there is still no standard for a European fibre strategy: public as well as private stakeholders are having very different approaches in local FTTx deployment sometimes leading to a waste in private and public funds and being mainly focused on dense areas. This article aims to propose an efficient model for fibre network deployment that can be applied to all European Member States. The model provides high-margin incentives for operators to install fibre network across the whole country, while maximising households’ fibre connection rate through an automatic migration scheme. In a period of weak growth and budget restrictions, the catch-up in ultra-fast broadband internet requires more than ever an efficient policy to maximise the deployment of FTTH at the lowest cost possible to the public. The proposed model serves as an ideal choice given this context.

Artigo: Do cobre à fibra: uma política de regulação ótima.


O papel da fibra é muito importante em conexões de banda larga de alta velocidade, uma das principais ações na área da Agenda Digital. No entanto, a Europa está atrasada no desenvolvimento da fibra, especialmente quando comparada com outras economias avançadas como Estados Unidos ou Japão. Ao mesmo tempo, porém, ainda não há um patamar para uma estratégia europeia para a fibra: detentores de haveres públicos e privados têm tido diferentes posturas no desenvolvimento de FTTx local, o que leva às vezes a um desperdício de fundos públicos e privados e sendo sobretudo registrado em áreas de densidade. Este artigo objetiva propor um modelo eficiente para o desenvolvimento da rede de fibra que possa ser aplicado para todos os Estados Membros Europeus. O modelo prevê incentivos altos para operadores para instalar redes de fibra por todo o país, enquanto maximiza a taxa de conexões domésticas de fibra através de um esquema de migração automática. Em um período de crescimento desacelerado e restrições orçamentárias, um novo impulso em banda larga de alta velocidade requer mais do que nunca uma política eficiente para maximizar o desenvolvimento de FTTH ao menor custo possível para o público. O modelo proposto serve como uma escolha ideal dado este contexto.

Articolo: Dal rame alla fibra: un’ottima politica di regolazione

Il ruolo della fibra è molto importante per la connessione ad alta velocità, una delle azioni centrali dell’agenda digitale. Tuttavia l’Europa è in netto ritardo per quando riguarda lo sviluppo della fibra, in particolare rispetto all’economia di altri paesi come gli Stati Uniti o il Giappone. Questo si capisce, però, in quanto non esiste uno standard per la strategia dell’Europa in materia di fibra: gli attori privati e pubblici del settore della fibra stanno avendo degli approcci differenti nei confronti della realizzazione dei FTTx, e tali approcci spesso si concludono in uno spreco di investimenti e si concentrano spesso su aree ad alta densità. Questo articolo si propone di trovare un modello efficace per la realizzazione di una rete a fibra in tutti gli Stati membri. Questo modello prevede degli incentivi elevati per gli operatori che installano delle reti a fibra ottica nei loro paesi, e massimizza la percentuale di connessioni a fibra ottica per nucleo familiare con un sistema di migrazione automatico. In un periodo di crescita ridotta e restrizioni di budget, lo sviluppo di connessioni a fibra ottica richiede una politica quanto mai efficace per massimizzare lo sviluppo del FTTH ai minimi costi possibili per i conti pubblici. Il modello proposto costituisce una scelta essenziale, in considerazione del contesto esistente.

Artículos: Del cobre a la fibra : una política regulatoria óptima


El rol de la fibra óptica es de gran importancia en lo que concierne la conexión al ancho de banda ultrarrápida, una de las áreas claves de acción en la Agenda Digital. Sin embargo, Europa se encuentra atrasada en cuanto a su desarrollo, especialmente en comparación con otras economías avanzadas, como la de los EEUU o Japón. No obstante, todavía no existe un estándar para una estrategia europea para la red de fibra óptica; accionistas, tanto privados como públicos, han estado adoptando diferentes acercamientos a la implementación de los FTTx, lo cual suele llevar a un enfoque sobre áreas demasiado densas y al desperdicio de fondos privados y públicos. Este artículo tiene como objetivo proponer un modelo eficiente para el desarrollo de la red de fibras ópticas que podría aplicarse a todos los miembros de la Unión Europea. El modelo provee incentivos de gran margen de ganancias para operadores para la instalación de estas redes de fibras a través del país entero y al mismo tiempo maximiza la conexión rápida de fibras en todas las viviendas facilitado por el uso de un esquema de migración automática. En un periodo de crecimiento débil y restricciones presupuestarias, el “catch-up” en el Internet de banda ancha ultrarrápida requiere ahora más que nunca una política eficaz para maximizar el desarrollo del FFTH y minimizar el coste incurrido por el público.

However, two representatives of the Bank of England, during the global meeting of central bankers in Jackson Hole in the US, have appointed what they believe to be the relevant criterion: simplicity. General Presentation

The Journal of Regulation (JoR) was created in 2009 Marie-Anne Frison-Roche to study Regulation as a developing phenomenon.

Regulation can be defined as a set of mechanisms, rules, institutions, decisions and principles that allow certain sectors of the economy to grow and maintain equilibriums that they could not establish solely via their own economic strength.

Over the past years, 'common rules' to all the sectors impacted by Regulation (e.g., transports, energy, telecommunications, banking, finance, insurance, etc.) have appeared beyond the sectorial regulations that have been issued for the past decades, whose specificity were once justified by the great variety of sectorial technicalities that used to impregnate in return the sets of rules designed to regulate those sectors.

Neither economics nor political science - namely throughout the declining figure of the State - are sufficient to capture this common organisation and projection into the future that Regulation is, which we must understand to anticipate its evolution and act in accordingly.

The newly developed "Regulation Law" restores what is common to all of those sectors using a triangulated approach between Law, Economics and Politics. This is all the more important since Regulation already tends to dissociate itself from its founding notion of "sector", not only to be increasingly associated with the more inclusive one of "branch", but also to get more and more autonomous- that is, for instance, the case of the digital issues that cannot be reduced to a "sector" anymore, but that still needs to be regulated.  

In order to follow, process, analyze and think about these issues, the Journal of Regulation (JoR), a mainly online-based bilingual publication (English-French), issues news reports, articles and thematic files.

The Journal of Regulation (JoR) issues a weekly newsletter to more than 10.000 people interested in Regulation throughout the world.

The Journal of Regulation regularly organizes public events. The last one, which is upcoming, is entitled 'Regulation, Supervision, Compliance'.

The Journal of Regulation issues its work in the Régulations Series, which are directed by Marie-Anne Frison-Roche and published by the Éditions Dalloz.

The Journal of Regulation operates basing on different committees, particularly a Partners Committee including the main organisations, companies and law firms acting within the field of regulated sectors, and a Global Committee composed of the main Regulatory Authorities.

After the close of financial markets , the Charmain of JP Morgan, Jamie Dimon, announced on 10 may 2012, the loss of 2 billion dollars on hedging activities. The announcement was carried out by a conference call, the Chairman saying the past that this is the result of errors of assessment and in the future that losses may increase. Commentators have pointed out that it made less legitimate criticism that this Chairman has always made on the regulation of banking of the Dodd-Frank Act and the ban of trading for own account, the press considered moreover that the manager has more shown by such a result the need of constraint to exercise in the future on banks. But should we have to confuse ad hoc case and the general rule to adopt? Is relevance of a critic and special case in which is described that is one was critical can be remain relevant?

 Presentation ot the theme: The digital space has been built on and as a system. Its primary interest is of a negative nature: it consists of to be preserved against the prospect of systemic failure, of not collapsing. Like all other systems, this 'Monumental Goal' specific to the digital system justifies resources that incorporate this concern for the future. As with all systems, it integrates and relies on the specific technical nature of this system.

The digital space is largely based on the invention, technology and architecture of domain names. Domain names, as an addressing system, enable users to enter the digital space and find other Internet users. The uniqueness and solidity of the domain name system, entrusted to a single root and decentralisation, makes this community possible for those who use the digital space and ensures the technical durability required, without which the digital space would be compromised.

The architecture, operation, operators and what they do under the control of legislators, regulators, judges and legal subjects are therefore examined from a dual technical and legal perspective, in the light of the imperative of sustainability.

This allows to progress in 4 stages.

Firstly, to examine the permanence in time and space of the domain name system, insofar as it is the foundation of the Internet and the digital system. This technical construction gives rise to legal qualifications, not only for the present but also for the future, since the Web3 offers new technical solutions.

Secondly, this technical sustainability is an imperative that is built into the operators of the domain names themselves, which are inter-linked not only at national level but also at global level, this cross-linking being necessary for the security of the system. The State is present through public law techniques that enable surveillance, control and possible recovery.

Thirdly, it imposes constraints on the operators subject to them in order to serve this monumental goal of technical sustainability, and these constraints themselves generate as many powers as they need to usefully achieve this mission. This proportionality must be at the heart of the method and the requirements. The relationship between constraints and powers also stems from it.

Fourthly, this imperative of technical sustainability, which is global in nature, gives way to imperatives of societal sustainability, more localised in space and time, when domain name operators are called upon by the legitimate authors of binding standards, legislators in the first instance, to express concerns such as the protection of people involved in the digital space and whose rights are compromised or who are in danger.

This second type of sustainability, which is more localised and less inherent in the architecture of the Internet, is justified by the available power of the operators concerned and their adherence to social imperatives. The resulting constraints and powers are therefore not the same.

The 2 sustainabilities must then be articulated in a conception that is both teleological and pragmatic.
