Breaking news

The optic fiber is a very difficult issue for regulators: they want its deployment, for the good of consumers, but they are not willing to pay much more for this and the operators are not prepared to invest without profitability. Incentives are insufficient and uncertainties, major flaw of the regulation, are very large. This is why the European Commissioner in charge of digital, Mrs. Neelie Kroes, announced that on the one hand that the system would now stable for regulation of the optic fiber and that on the other hand there is no more tendency of the regulator to lower the price of access to cost method which discourage operators to invest.

On December 20, 2011, the Autorité de Régulation des Communications électroniques et de la Poste (ARCEP — French postal and telecommunications regulator) fined La Poste, France’s universal postal service provider, one million Euros for not having provided an easily-available and affordable priority mail service for the shipment of low-value objects weighing less than two kilograms. This failure was in disregard of the regulator’s injunction, French legislation, and European directives.

Par une décision du 20 décembre 2011, l’Autorité de Régulation des Communications Electroniques et de la Poste (ARCEP), condamne à une amende d’un million d’Euros l’opérateur en charge du service universel, La Poste, car celle-ci n’a pas offert d’une façon accessible et abordable, sur un modèle proche de la « lettre », l’envoi d’objet de faible valeur de moins de deux kilos. En cela, l’opérateur a méconnu la mise en demeure du régulateur, la loi française et les directives communautaires.

Este fallo fue un acto de indiferencia del mandamiento judicial del regulador, de la legislación francesa y de las directivas europeas.

The Autorité de la régulation des communications électroniques et des postes - ARCEP (French Telecommunications and Posts Regulator) organized the Colloquium on "la neutralité des réseaux" The Network Neutrality), which took place on April 13, 2010. Each actor uses the generality of the term ‘neutrality’ in an interpretation that best suits his opinions. However, neutrality means that there should be no discrimination between Internet users; however, it does not mean that they have the right to everything for free: because there has to be some sort of traffic and bandwidth management, consumer and copyright protection, it is necessary to strike a balance between these contradictory rights in order to allow the network to develop. Therefore, a regulator is necessary. The future development of the Internet depends upon it. For the moment, nobody knows who these legitimate regulators are, and how they would be able to regulate these competing forces, organize information transparency, and encourage long-term investment, while preserving competition at the same time.

On November 4, 2010, the French telecommunications regulator obliged a fiber optic network operator to obey certain conditions for the access to civil engineering infrastructures that it had not accepted in its contracts with the civil engineering infrastructure operator. The Court of Appeals of Paris confirmed this ruling on June 23, 2011 on the grounds that the civil engineering operator required all fiber optic network operators to behave identically.
