“Global Financial Integration, Thirty Years on. From reform to crisis”
combines many academic contributions on international financial
governance, that each offer original and in-depth analysis of the
financial crisis’ causes. To safeguard the authors’ legal and economic
reasoning, the bibliographical report has been divided in three parts
and will be brought to The Journal of Regulation’s readers in three
successive issues . The following report analyses the third part of the
volume.
The « Centre d’analyse stratégique », the strategic analysis think-tank that is part of the French Prime Minister’s cabinet, published the report of the working group presided by Christian Stoffaës on the theme of « La securité gazière en Europe : de la dépendance à l’indépendance » (The Security of Natural Gas Supply in Europe : from dependence to independence). This report highlights the fact that Europe is in danger, in the long run, of not having access to enough gas and of becoming overly-dependent on its foreign suppliers. Europe must therefore establish policies to reduce and modify its natural gas consumption, and establish energy partnerships with Russia, North Africa, and finally, the Middle East. Europe must realise that competition is nothing more than a means to an end and must implement a true Regulation of the energy sector, in order to create secure conditions that avoid energy crises. Risk management can be achieved by creating emergency reserves; through the regulation of transport network infrastructures; and a renewed ‘energy solidarity’ using the interconnections at member states’ borders. Thereby, Europe will evolve from dependency to independency, which will ensure its natural gas security despite its insufficient supply
A series of decisions handed down by the European Court of Justice on March 9, 2010 reduces the burden of proof for environmental damages, in order to facilitate the application of the 'polluter pays' principle, and provides national regulatory authorities broad powers in enforcing environmental liability.
In an article written in French, the press of Senegal reported a conference in which the First President of the Dakar Court of Appeal stated that the judicial court - in the present case the Dakar Court of Appeal - after being a bit "frightened "by the regulatory law, because of its technicality, and after its fear of being dispossessed of cases because of the power of that the regulatory authorities in place to exercise the dispute resolution, is able to play its role today.

PeruRail, the operator of Peru’s famous railway line, providing service between Cuzco and Machu Picchu, was sanctioned USD$800,000 on May 10, 2010 by the {‘Instituto Nacional de Defensa de la Competencia y de la Protección de la Propiedad Intelectual’} (INDECOPI- Peru’s national institute for the defense of competition and protection of intellectual property) for having restricted competitors’ market entry. An appeal is underway.
The postal Regulation Authority (PostReg) is an independent body attached to the Federal Department of the environment, transport, energy and communication (DETEC). It has the mission to assess the liberalisation of the sector and its proper functioning. In its report presented on May 14, 2012, it notices first of all the satisfactory quality of the service provided by the Post, since not only the mails but the packages arrived on time. But concerning the openness to competition, the monopoly held by the Post on the mail lets him maintaining a dominant position on the market of the package. The regulator said that the law already adopted will establish a new authority, the Commission of Post (PostCom) which will further promote new entrants.
Competition is the principle element of markets, in the princely sense of the term.The relationships that regulation maintains with competition are ambiguous. It is important to eliminate this ambiguity in order to reveal the ab initio opposition between regulation and competition, to shed light upon the dialectics between both of them. Indeed, regulation may aim at building competition, and is thereby presented as a tool that will cease being used when the competitive market functions effectively.

É importante eliminar essa ambiguidade de modo a relativizar a oposição ab initio entre regulação e concorrência, para trazer luz para a dialética entre elas. Com efeito, regulação pode tender a construir a concorrência, e é então apresentada como uma ferramenta que deixará de ser usada quando o mercado competitivo passar a funcionar realmente.

La concorrenza è il principio fondamentale dei mercati, nel senso stretto del termine. Le relazioni tra regolazione e concorrenza sono ambigue. Per rivelare il contrasto tra regolazione e concorrenza è importante cancellare questa ambiguità e chiarire la dinamica di questi due concetti. In effetti, la regolazione punta a sviluppare la concorrenza ed è spesso considerata uno strumento che non avrà più ragion d’essere una volta che il mercato funzionerà in libera concorrenza.

La competencia es el elemento principal de los mercados, en precisamente el sentido de este término. Es importante eliminar esta ambigüedad para poder revelar la posición ab initio entre la regulación y la competencia, para poder traer a luz las dialécticas entre las dos. Así tanto, la regulación puede intentar construir la competencia, y es, por consiguiente, un instrumento que cesará de ser utilizado cuando el mercado competitivo funcione de manera eficaz.
On December 10, 2010, the Commission de Régulation de l’Energie (CRE – French Commission for Energy Regulation) and the Autorité des marches financiers (French Securities Regulator – the AMF) entered into a memorandum of understanding (the MoU). Cooperation between these two sector based regulators is, for the most part, set against the background of, and aims at, a better (or, rather, burgeoning) regulation of the market for CO2 emission allowances and is grounded in the following principles:
- both regulators undertake to transmit information necessary to fulfilling each other’s respective expanded legal mandate, i.e.:
o protecting investments made in CO2 emission allowances (e.g. by detecting and punishing market abuses, i.e. insider trading, market manipulations, dissemination of false information) for the AMF and;
o overseeing transactions made by market participants on the spot and derivatives markets for CO2 emission allowances to make sure that such transactions are in line with transactions made on the markets for electricity and natural gas for the CRE;
- such mutual information is to notably take the form of regular bilateral meetings at various levels and mutual information may now cover data that the AMF had to keep confidential due to strict legal privilege restrictions applicable to its officers.
