In order to properly conceive the role of law in the economic sphere, a problem that is usually designated as “good regulation”, it can be instructive to confront what such a concept denotes to one of the most prominent theories of the rule of law in modern societies, the theoryof F. A. Hayek.

Several German representatives for regional data protection demanded that Facebook complies with EU and German law. Two major complaints concern Facebook’s facial recognition software and its "Like"-button.

The European Medicine Agency (Agence européenne du Médicament - EMA) launched on May 31, 2012 a database, available on an Internet site, indicating "suspicious side effects" of drugs allowed on European Union markets. The information comes both of the different authorities of national regulation of drugs and pharmaceutical companies who spontaneously reported these side effects.

The creator of Wikileads, Julian Assange, has been the subject of a documentary which was screened on British television Channel 4, in which he is seen dancing in a night club. Believing that there is a violation of his privacy, he seized the British media regulator, Ofcom. The latter, by a decision of 10 September 2010, rejected the complaint, based not so much on the argument that it is a public place and that the image has already been circulated but rather the plaintiff has been associated with the development of documentary and he could give additional facts or contradictory arguments to those gathered by the channel. Passenger transport markets in Europe have been, and continue to be, liberalised across jurisdictions and sectors.

Since July 2015, passenger coach operators in France have been allowed to operate without regulation on longer routes (over 100km). For shorter routes, ARAFER, the French regulator for rail and roads, will test whether the coach service is likely to threaten the viability of the public rail service offered by SNCF on the same route. What changes could this reform bring, and how might the economic test be applied?

The elections in Senegal bring in power a new President of the Republic. Almost immediately after, the Director General of the Autorité de Régulation des Télécommunications et des Postes (ARTP) – (Regulatory authority of telecommunications and posts) is replaced. It took the form of a Decree of April 19, 2012. The new Director General is Mr Ndongo who is Telecommunications engineer.

The Autorité de la régulation des communications électroniques et des postes - ARCEP (French Telecommunications and Posts Regulator) organized the Colloquium on "la neutralité des réseaux" The Network Neutrality), which took place on April 13, 2010. Each actor uses the generality of the term ‘neutrality’ in an interpretation that best suits his opinions. However, neutrality means that there should be no discrimination between Internet users; however, it does not mean that they have the right to everything for free: because there has to be some sort of traffic and bandwidth management, consumer and copyright protection, it is necessary to strike a balance between these contradictory rights in order to allow the network to develop. Therefore, a regulator is necessary. The future development of the Internet depends upon it. For the moment, nobody knows who these legitimate regulators are, and how they would be able to regulate these competing forces, organize information transparency, and encourage long-term investment, while preserving competition at the same time.
