The author shows that the Conseil d’Etat (French Council of State) since 1999 considered itself as le régulateur de l'ordre juridictionnel français (controller of the French court order), which shows the priority of the use of this concept in the administrative order before it is used in the economic order.
For the Council of State, the purpose is not to create a new branch of law, but to ensure its function within the institutional system of administrative courts. For example, the Council of State regulates the flow of litigation or resolve inconsistencies between jurisdictions.
